Public Services Backward Classes Welfare Department Recruitment Filling up of (1698) one thousand six hundred and ninety eight vacant post in Mahatma JyothibhaPhule Telangana Backward Classes Welfare Residential Educational Institute Society (MJPTBCWREIS) by Direct Recruitment through Telangana Residential Education Institutes Recruitment Board (TREI-RB) – Orders – Issued. 

Government of Telangana have reviewed the direct recruitment vacancy position in Mahatma JyothibhaPhule Telangana Backward Classes Welfare Residential Educational Institute Society (MJPTBCWREIS).

After careful examination of the proposal furnished by the Department and keeping in view of the actual requirement of manpower with reference to the nature of work and activities of the department and also the overall financial implications, Government hereby accord permission to fill up one thousand six hundred and ninety eight (1698) vacant post in in Mahatma JyothibhaPhule Telangana Backward Classes Welfare Residential Educational Institute Society (MJPTBCWREIS), sanctioned vide the G.O., by Direct Recruitment, through Telangana Residential Education Institute Recruitment Board as shown below:-

The Secretary, Telangana Residential Education Institutes Recruitment Board (TREI-RB), Hyderabad  shall take appropriate steps for filling the above vacancies through direct recruitment by obtaining the details, such as local cadre wise / vacancy position, roster points and qualifications etc., from the concerned authorities. The Secretary, Telangana Residential Education Institute Recruitment shall issue the notification and schedule for recruitment expeditiously. 

The administrative department and the Head of Department concerned shall furnish details of all vacant posts authorized in this order, including the local cadre wise / roster points and qualifications, etc., to the recruiting agency immediately under intimation to Finance Department. The Department shall issue necessary amendments to their service rules / Bye-laws / Government Orders changing the existing recruitment procedure /recruiting agency wherever necessary.

Committee for CAS regular promotions in AP for Associate Professors, Professors

Implementation of Career Advancement Scheme CAS to the teaching faculty of Medical Colleges and Dental Colleges of Andhra Pradesh – Constitution of Committee – Orders 285 on July 7, 2019.

Government certain guidelines / procedure were issued for implementing Career Advancement Scheme to the teaching faculty working in the Government Medical Colleges and Dental Colleges.

Whereas, in the G.O. orders were also issued regarding procedure for extension of Career Advancement Scheme to the cadre of Associate Professors, Professors, Additional Directors and Directors.

And whereas, in the letter 3rd read above, the Director of Medical Education has sent a proposal for appointment as Designed Professors in the Speciality of General Medicine in terms of G.O. and he has requested the Government to take necessary action in the matter.

After careful examination of the matter, Government have decided and hereby constitute a Committee at Govt. level to follow the procedure as adopted in regular promotions such as Screening Committee / DPC etc. for implementation of Career Advancement Scheme (time bound pay scales) for the cadre of Associate Professors, Professors, Additional Directors and Directors as per the orders issued in G.O. above as follows:-

1. Special Chief Secretary/Principal Secretary/ Secretary to Government, HM&FW Dept., ….. Chairman

2. Addl.Secretary/Joint Secretary/ Deputy Secretary to Government, HM&FW Dept., …… Member

3. Director of Medical Education, A.P., Vijayawada .….. Member-Convener

Promotions under Career Advancement Scheme shall be given as per the fulfillment of the criteria and not on the basis of the vacancy. The doctor will get financial benefit as well as re-designated as Associate Professor and Professor etc., but the physical position shall not change. The physical position will be given whenever a vacancy arises as per their seniority.  For Career Advancement Scheme (time bound pay scales), the procedure as adopted in regular promotions such as Screening Committee / DPC etc., shall be followed.

The candidate shall possess Technical and Academic qualifications as per MCI guidelines.

The candidates shall not have any adverse entry in ACR reports of last preceding 5 / 3 years Assistant / Associate Professors respectively. 

Evaluating performance, punctuality, regularity & professional efficiency shall be done before giving time bound promotions.  In the above Career Advancement Scheme (CAS), the PP allowed at present shall be adjusted in their pay on regular line and they will get due promotions as per their eligibility.

The Career Advancement Scheme (CAS) shall be implemented with effect from 01.11.2006 and monetary benefit shall be given with effect from the date of issue of these orders.

The Director of Medical Education, A.P., Vijayawada is the competent authority for sanction of Career Advancement Scheme (CAS) on production of the requisitions from the concerned Principals / Superintendent for the cadre of Assistant Professors and Associate Professors. Government is the competent authority for the cadre of Professors, Additional Directors and Directors. 

Assistant Professors

i) For the Assistant Professors who have completed 4 years in broad specialty / 2 years in super specialty teaching, will be given Career Advancement Scheme irrespective of vacancy and they are   re-designated as Designated Associate Professor. Two (2) Research Publications as 1st or Corresponding Author published in Indexed / Journals during the tenure of Assistant Professors is mandatory. Fixation of pay as per the fitment table. The scale of pay will not change.  The Academic Grade Pay shall be changed from Rs.7,000 to Rs.8,000/-. 

(As per MCI guidelines 1st author and corresponding author are only considered from 05.06.2017 as amended vide Notification No.MCI12(1)/2017-Med.Misc./115698, dated 05.06.2017).

For the Designated Associate Professors who have completed three years of service, the time scale shall be changed from Rs.18,600-39,100 to  Rs.37,400-67,000 and applicable grade pay will be Rs.8000.

The Designated Associate Professors who have completed six years of service, they may be called as Designated Professors and their time scale shall not change. The academic grade pay shall be changed from Rs.8,000 to Rs.9,000. For re-designation one should publish Two (2) Research Publications as 1st or Corresponding Author published in Indexed / Journals during the tenure of 10 years teaching. (Total 4  Research Publications).

The Designated Associate Professor / Designated Professor if promoted on regular basis (Vacancy based) as Associate Professor one increment shall be given in the existing time scale as on date.

Associate Professors

  1. The Associate Professor who have completed more than 10 years of teaching from the beginning of the service as Assistant Professor will be given Career Advancement Scheme irrespective of availability of vacancy. They may be called as Designated Professors.  Fixation of pay as per the fitment table, the scale of pay changed from Rs.18,600-39,100 to Rs.37,400-67,000 and applicable grade pay Rs.9,000. They should have published Two (2) Research Publications as 1st or Corresponding Author published in Indexed / Journals during the tenure of Associate Professor or a cumulative of 4 papers of which two papers as Associate Professors.
  2. No Change in the pay scale and grade pay but he/she will be given Career Advancement Scheme irrespective of vacancy.  They may be called as Designated Professor.
  3. The designated Professors who have completed three years of teaching will be given Career Advancement Scheme and time scale will not change. The academic grade pay will be changed from Rs.9,000 to Rs.10,000.
  4. The Associate Professor / Designated Professor if promoted on regular line (Vacancy based) as Professor, one increment shall be given in the existing time scale as on date.

200 units Free Power Scheme in Andhra Pradesh GO 91

Scheduled Castes Component 2019–20  ‘Jagjeevan Jyothi’ Enhancement of benefit under the Free Power Scheme from (100) units to (200) units to the eligible SC households as per the announcement in MANIFESTO – Orders -Issued.

Government of Andhra Pradesh have issued orders for the payment of electricity charges to benefit the SC & ST households, living in SC & ST colonies with monthly consumption of 0-50 units per month, provided that the DISCOMS concerned give detailed consumption particulars of each beneficiary.

Government of Andhra Pradesh have launched the ‘Jagjeevan Jyothi’ scheme, duly enhancing the benefit of Free Power up to (75) Units from the existing (50) units in respect of the SC & ST households, consuming power up to (100) Units per month.

Government of Andhra Pradesh have issued orders for enhancing the benefit of Free Power Scheme from (75) units to (100) units in respect of the SC & ST households, consuming power up to (125) Units per month.

During the Cabinet meeting held on 10-6-2019, the Hon’ble Chief Minister has instructed to extend the benefit of Free Power up to (200) units from the existing (100) units to the eligible Scheduled Castes Households in the State, as per the announcement in MANIFESTO in order to ensure that the benefit the larger number of eligible poor SC families. The Director of Social Welfare vide reference 8th read above has submitted proposals accordingly.

Government after careful examination of the above proposal, hereby enhance the benefit for providing Free Power from 100 units to 200 Units to SC Eligible Households consuming power up-to 200 units per month in the State under the Hon’ble Chief Minister, Assurance in MANIFESTO, duly covering an additional 2.82 lakh SC families (with an additional subsidy amount of Rs 107.24 crores per annum).

The Director of Social Welfare is permitted to incur the expenditure for the above purpose under Head of Account “2225-01-800-11-08-330-000” and he is permitted to meet the additional amount required for the purpose by reallocation within Scheduled Castes Component 2019-20, at the appropriate time.

In order to ensure the proper implementation of the scheme and in order to ensure that the benefits under the scheme are availed all the eligible SC beneficiaries, Government further orders that:

a) The concerned DISCOMs & RESCOs shall mandatorily obtain and the enter in the scheme database the (a) Aadhar Number (b) Mobile Number (c) Caste Certificate (Mee Seva certificate or Certification by the DISCOMs) of all the Scheduled Castes consumers availing the benefit under the scheme, by 31st October,2019.

b) The DISCOMs & RESCOs shall issue (a) Distinct electricity bill to the consumers benefitting under this scheme (b) Dispatch SMS & Voice message, every month, to the consumers. (c) Take up a widespread awareness campaign under the scheme, along with the Social Welfare Department.

These enhanced benefit under the scheme shall come into force w.e.f. August bills payable in September 2019, as per the bill cycle of the DISCOMS & RESCOs.

This order is issued with the concurrence of the Finance (FMU-Welfare.1) Dept., vide their U.O.No.FIN01-FMU0PC(WEL1)/55/2019; Dt.8.9.2019(Com No.927359).

During the review meeting held on the 18-7-2018, on the activities taken up by the Social Welfare & Tribal Welfare Department, the Hon’ble Chief Minister has instructed to extend the benefit of ‘Jagjeevan Jyothi’ scheme to up to (100) units from the existing (75) units to the eligible Scheduled Castes & Scheduled Tribes households in the State, in order to ensure that the benefit of the scheme reaches to a larger number of eligible poor SC & ST families deserving support from the Government, and the same was communicated. The Hon’ble Chief Minister has further agreed to extend the benefit of the free power scheme of up to (100) units in respect of the eligible SC & ST households, consuming power up to (125) Units per month.

In view of the above, and after careful examination of the proposal of the Director of Social Welfare in the reference, Government hereby enhances the benefit under the ‘Jagjeevan Jyothi’ scheme from (75) units to (100) units to the eligible SC & ST households consuming power up to (125) units per month, duly covering an dditional 4.67 lakh SC families(with an additional subsidy amount of Rs 38.65 crores per annum) and an additional 0.50 lakh ST families(with an additional subsidy amount of Rs 5.78 crores per annum).

5. The Director of Social Welfare is permitted to incur the expenditure for the above purpose under Head of Account “2225-01-800-11-08-330-000” and he is permitted to meet the additional amount required for the purpose by reallocation within Scheduled Castes Component 2018-19, at the appropriate time.

The Director of Tribal Welfare is permitted to incur the expenditure for the above purpose under Head of Account“2225 -02-102-11-11-330-000” and he is permitted to meet the additional amount required for the purpose by reallocation within Scheduled Tribes Component 2018-19, at the appropriate time.

25 Lakh House sites for Houseless poor Andhra Pradesh

Andhra Pradesh Lands Provision of 25 lakh House sites / Housing Units to Houseless poor people – Constitution of Committee with Officers – Orders – Issued. 25 Lakh House sites for Houseless poor Andhra Pradesh with GO 797.

The Government have decided to provide 25 lakh House sites/Housing Units to Houseless poor people in coming 5 years period in the State. Wherein sites have to be provided by Ugadi 2020. Accordingly, Government hereby constitute a committee with the following members to have better inter-departmental coordination in evolving road map and for regular monitoring of the programme of providing House Sites/ Housing Units both in rural and urban areas in the State of Andhra Pradesh:

25 Lakh House sites for Houseless poor Andhra Pradesh

In 2017, Government have accorded Administrative sanction for construction of 1,20,950 EWS houses including 5786 houses sanctioned under Hud Hud Cyclone project under PMAY –HFA(Urban) in 3 models in 37 ULBs with Central Assistance of Rs.1.50 Lakhs and State Government assistance of equal share of Rs.1.50 Lakhs in addition to providing land owned by ULB/ Government at free of cost and also approved EPC tendering system on e-procurement platform for the projects with shear wall technology.

MD, APTIDCO has informed that the Commissioner, CRDA, Amaravati has reported that as a part of Land Pooling scheme, the Government have announced to provide housing for the houseless poor in capital city area and that the CRDA has conducted a detailed Socio Economic Survey in the capital city area and it has been identified that about 7000 families do not have pucca houses and they are residing in temporary houses in encroached lands and as tenants. In a review meeting on 04-05-2017.

It has been decided to construct about 5000 houses in about 10 locations spread across the capital city area under Pradhan Mantri Awas Yojana (PMAY) and the APCRDA has identified 10 parcels of land and also proposed to construct the houses in the following categories :

The MD, APTIDCO has also reported that in the said meeting, the Commissioner, CRDA, Amaravati has suggested to built Cellar+7 structures, since the foundation cost in the capital city is high, as it requires pile foundation, to maximize the economic value of the pile foundation.

In the said meeting, it has also been decided that the CRDA shall hand over 50 acres of land located in 10 different locations to APTIDCO to carry out construction of 5000 houses under Pradhan Mantri Awas Yojana (PMAY).

The Director (Land and Social Development), APCRDA shall provide the list of beneficiaries and tie up with Banking institutions.

It has also been decided to construct 992 houses with 300 Sft, SBA ,1536 houses with 365 Sft and 2496 houses with 430 Sft under G+3 Pattern with Shear wall (Monolithic Technology) in 10 locations at CRDA, Amaravati with the following unit cost and Project cost that was prepared based on Shear wall (Monolithic) Technology with current SSR rates 2016-17.

The MD, APTIDCO has therefore requested the Government to accord Administrative sanction to the above Unit costs and also to total Project cost of Rs. 344.97 Cr as the estimates were prepared adopting 2016-17 SSR Rates for Shear wall (Monolithic) Technology for carrying out civil and internal infrastructure facilities (such as Electrical, Plumbing, Water supply works) of houses in G+3 pattern for the 5,024 houses with a completion period of Fifteen months (15) in Amaravati, CRDA of Andhra Pradesh.

Mission Bhagiratha Techno Economic Viability Study

Mission Bhagiratha Techno-Economic Viability Study Engineer-in-Chief, Mission Bhagiratha, Hyderabad has submitted proposals for the appointment of consulting Agencies for conducting Techno-Economic Viability (TEV) Study for Mission Bhagiratha Project as Telangana Drinking Water Supply Corporation Limited (TDWSCL) does not have relevant exposure to engage consultants and fix up the fees.

The Mission Bhagiratha is one of the Flagship programmes of the Government with an objective to provide safe drinking water on a sustainable basis at household level in all the Rural and Urban habitations in the Telangana State Mission Bhagiratha Techno-Economic Viability Study (Excluding Hyderabad Urban agglomeration within the Outer Ring Road). 

The administrative sanction amount  Rs. 36,255.64 crores, Rs. 28,420.00 crores worth projects were tied-up for loan with NABARD, HUDCO and various commercial banks for certain segments having components like Intake, allied works, WTPS and Transmission System by the Telangana Drinking Water Supply Corporation Mission Bhagiratha Techno Economic Viability Study .

In this regard, Government have conducted a meeting with all bankers and explained the status of Mission Bhagiratha and funds needs to be tie-up for the remaining works, in which the bankers have highlighted that the loan amount proposed originally with commercial banks were revised latter.

Therefore, it was proposed for conducting a techno economical viability study with approved empanelled Consultants for furnishing of latest credit rating of the corporation to the bankers for further loans feasibility of sanction and further disbursement for sanctioned loans.  

ENC has stated that the APITCO Ltd, Hyderabad has submitted proposal to undertake TEV Study of Mission Bhagiratha Project, duly indicating a fee of Rs.30.03 Lakhs (excluding taxes). Later, based on the oral instructions of the MD, TDWSCL, in consultation with the Finance Secretary (IF) and in view of urgency for taking up the Study, APITCO Ltd., Hyderabad carried out the TEV Study on Mission Bhagiratha Project and submitted the final report to TDWSCL during the month of July 2017.

Later, it was ratified by the Board Meeting of Board of Directors of Telangana Drinking Water Supply Corporation Limited (TDWSCL) held on 10.11.2017, for appointment of APITCO as consultants towards preparation and issue of TEV Study with a consultant fee of Rs 25.00 Lakhs   and authorized the MD, Telangana Drinking Water Supply Corporation Limited (TDWSCL)  to negotiate and arrange for payment of fee thereon

A decision was taken to constitute a Committee for negotiating and finalizing the consultancy fee to be paid to APITCO Ltd., towards the TEV Study on Mission Bhagiratha Project

Accordingly, The ENC has while communicating the minutes of (4) member committee constituted on 25.2.2019 & 26.2.2013 has stated that the consultancy fee to be paid to APITCO ltd., Hyderabad towards TEV study on Mission Bhagiratha Project  was finalized and concluded to credit  a total amount of Rs. 29.50 lakhs as consultation fee + GST 18% to the PD Account of  the MD, TDWSCL, Hyderabad for payment to APITCO ltd., Hyderabad duly debiting the expenditure from the Head of Account : 4215-01-102-25-31-530-531

Engineer-in-Chief,
RWS&S, Hyderabad observed that higher capacities of Over Head Balancing Reservoirs (OHSRs) are in TDWSP project and for completion of staging the payment condition in the agreement is provided as 20%, whereas in Intra Village works, the capacity of OHSRs is small. Nearly 10,000 number of OHSRs having capacity 10,000 Liters to 20,000 Liters are to be constructed with local contractors who is having limited finance source. Earlier for NRDWP works, 40% payment is included in the agreement for completion of staging.

Further, modified orders will improve the financial status to the contractors and help in completion of OHSRs. Therefore, hereby issue the following amendment as appended to the Annexure at Sl.No.01 (a) regarding Payment conditions and also accord permission to extend the modified payment conditions to the works already entrusted duly issuing an amendment to agreement conditions.

GO 39 Guidelines for implementation of Reservation for EWS in Andhra Pradesh

Government of Andhra Pradesh with GO 39 Issued Guidelines for implementation of Reservation for Economically  Weaker Sections(EWSs)-Admissions to Higher Education Institutions.

In accordance with the provisions of the Constitution  (One hundred and third Amendment) Act, 2019, and the reference of Ministry of Social  Justice  and Empowerment vide O.MNo.20013/01/2018-BC-II, Dated:17.1.2019, enabling  provisions of reservations for the Economically Weaker Sections (EWSs) who  are not covered under the existing  scheme of  reservations  for the Scheduled Castes,the Scheduled Tribes and the Socially and Educationally Backward Classes it has been decided to  provide reservation in admission to educational institutions subject to a maximum of ten percent  of the total seats in each category. This would not apply to the minority education  institutions  referred to in clause (1) of Article  30  of  the  Constitution  of India . 

The provision of reservation to the Economically Weaker Sections shall be in   accordance with the directions contained in the O.MNo.20013/01/2018-BC-II, Dated: 17.1.2019 of the Ministry of Social Justice  & Empowerment, GOI, New Delhi. find below how to apply economically weaker section certificate in Andhra Pradesh.

Persons who are not covered under the existing scheme of reservations for the Schedule castes, the Schedule Tribes and the Socially and Educationally Backward Classes and whose family has gross annual income below Rs.8.00 lakhs are to be identified as Economically Weaker Sections (EWSs) for the benefit of reservation.

Family for this purpose will include the person who seeks benefit of reservation, his/ her parents and siblings below the age of 18 years as also his/ her spouse and children below the age of 18 years.

Guidelines for implementation of Reservation

The income shall include income from all sources i.e. salary, agriculture, business, profession, etc., and it will be income for the financial year prior to the year of application. Also persons whose family owns or possesses any of the following assets shall be excluded from being identified as EWSs, irrespective of the family income:

1)5 acres of Agricultural Land and above.

2)Residential flat of 1000 sq.ft and above.

3) Residential plot of 100 sq. yards and above in notified municipalities.

4) Residential plot of 200 sq. yards and above in areas other than the notified municipalities.

Every Educational Institution shall  increase the number  of seats  over and  above  its annual permitted strength  in each branch of  study  or faculty  so that the number of  seats available, excluding  those reserved  for the persons belong to the EWSs, is not  less than  the  number of  such seats available, in each category,  for the academic  session immediately  preceding the  date of the coming  into force of the office Memorandum of MHRD, GOI 1st cited. 

Govt after careful examination of the matter have  hereby decided to implement  the above said provisions  in accordance  with 103rd Constitutional Amendment Act, 2019 and the guidelines issued by Govt., of India vide Office Memorandum F.No.36039/1/2019-Estt(Res.) Dated: 19.01.2019. and the guidelines issued by the Ministry of HRD, GOI, vide F.No.12-4/2019-U1, Dated:17.01.2019. 

The guidelines relevant for current academic year 20192020, in regard to the subject matter consistent with 103rd Constitutional Amendment, would read as under:

Govt after careful examination of the matter have  hereby decided to implement  the above said provisions  in accordance  with 103rd Constitutional Amendment Act, 2019 and the guidelines issued by Govt., of India vide Office Memorandum F.No.36039/1/2019-Estt(Res.) Dated: 19.01.2019. and the guidelines issued by the Ministry of HRD, GOI, vide F.No.12-4/2019-U1, Dated:17.01.2019. 

The guidelines relevant for current academic year 20192020, in regard to the subject matter consistent with 103rd Constitutional Amendment, would read as under:

  1. All Castes which are not covered under any reservation category (SC/ST/BC) are entitled to avail of the reservation facility under EWS Category.
  2. The students admitted under EWS Category will be adjusted against the 10 percent of the sanctioned seats granted additionally, as is followed by the Government of India. However, 1/3rd (33 1/3) of the seats enhanced for the purpose of accommodating the EWS Category students shall be earmarked to women among them.
  3. The model format of the EWS Certificate prescribed by Government of India in Annexure-I vide their 0.M.No.36039/1/2019-Estt. (Res), Dated: 31-1-2019 shall be followed along with the conditions referred in para 2 above.
  4. The persons seeking the benefit of reservation under EWS category shall obtain the necessary EWS Certificate issued by the Tahsildar concerned.     
  5. The eligibility conditions for a person to avail of the facility Of EWS reservation are the same as fixed by the Government of India as referred in Para 2 above:  
  6. In this regard, every   educational institution in AP shall increase the number of seats  over  and above its annual  permitted strength  in each branch of study or faculty from the academic year 2019-20. Further, the number of seats available, excluding those reserved  for the persons belonging  to the EWSs, should not  be less than the number of seats that were available in each category, for  the previous academic session of 2018-19.
  7. The Scheme for implementing the reservation for the EWSs  shall be displayed on the website for every educational institution immediately.

1 TMC of water from Sundilla barrage to Singareni Collieries Company Limited

Engineer-In-Chief (Irrigation), Hyderabad has reported that the Chairman & Managing Director, the Singareni Collieries Company Limited, Hyderabad in his letter dt. 12.07.2018  has informed that water is being drawn since 19-08-2015 for power Generation through infiltration gallery in the river Godavari near Shetpally village, Jaipur (M), Mancherial (D). 1 TMC of water from Sundilla barrage to Singareni Collieries Company Limited

This reach of the river is now coming under Sundilla reservoir, a part of Kaleshwaram Project.  At the time of framing of Kaleshwaram Project as per DPR the broad water allocation for Industrial usage is 16 TMC . 

He has further stated that, the Chief Engineer, KP, KNR has opined that the allocation of 1 TMC of water per annum from Sundilla Project to cater to the needs of 2X 600 MW STPP at Jaipur, Mancherial can be considered from the water earmarked for industrial usage i.e. 16 TMC of Kaleshwaram Project.

The Engineer-in-Chief (I), Hyderabad, in his  letter has stated that  the Executive Director, STPP has informed that the power plant life  is 25 years i.e., up to 2041 and water is to be drawn from river Godavari at Shetpally for power generation purpose till the end of its life span.  However, water drawl permission is requested for an initial period of 5 years.

The Engineer-in-Chief (I), Hyderabad in his letter,  has further stated that in  G.O.Rt.No.474, Dt: 19-07-2010 , the Government had previously accorded permission to SCCL for drawl of 2 TMC of water from Pranahitha river at 1 KM upstream of the confluence of Pranahitha and Godavari rivers near Devalawada (V), Jaipur (M) of Adilabad District for their 2 X600 MW STP plant. The SCCL has been drawing water from Devalawada (V) as per the above approval accorded by the Government , since September 2018.

Apart from the above approval for 2 TMC with drawl point at Devalawada (V), SCCL has also been drawing water through the infiltration gallery in Godavari river near Shetpally (V) , Mancherial  District since August 2015, as per the permission accorded by the Ground Water Department for 18 MGD vide Le.No. 157/T/2008 dt: 07-08-2008.  Now, due to construction of Sundilla barrage under Kaleswaram barrage, this drawl point @ Shectpally (V) will be coming under submergence of the barrage. 

He has also stated that to regularize the drawls already being done from the infiltration galleries in Godavari river at Shetpally (V) , which was based on the permission of Ground Water Department , SCCL has requested to accord formal approval of the Government for drawl of 1 TMC from Sundilla barrage.  In view of construction of Sundilla Barrage, the ENC (Irrg.)  proposed to allocate 1 TMC from the water earmarked for industrial usage of 16 TMC for Kaleshawaram Project.

The Engineer-in-Chief  (I), Hyderabad has requested the Government to accord permission for allocation of 1 TMC of water from Sundilla barrage (foreshore) at Shetpally (V), Jaipur (M), Mancherial District to Singareni Collieries Company Limited for an initial period of  5 years as per prevalent rules for the 2 X600 MW STPP from the allocation at 16 TMC earmarked for industrial usage under Kaleswaram Project. 

Government after careful examination of the proposal of the Engineer-in-Chief (Irrigation), Hyderabad hereby accord permission for allocation of 1 TMC of water from Sundilla barrage (foreshore) at Shetpally (V), Jaipur (M), Mancherial District to Singareni Collieries Company Limited for an initial period of 

5 years as per prevalent rules for the 2X600 MW STPP from the allocation of 16 TMC earmarked for industrial usage under Kaleswaram Project, subject to obtaining permission from District Collector, Mancherial District and Pollution Control Board before drawl of water and  obtaining other Departments  permissions as per Law/Rules. The water charges are to be collected as per G.O.Ms.No.115, I & CAD (Reforms)Dept., dt. 27.06.2015.

The management of the instant college is directed to fulfil all the norms and standards stipulated, as amended from time to time by the National Council for Teacher Education or else. Consequent on election of new Members to the Telangana State

Legislative Assembly in December, 2018 and also constitution of new Lok Sabha in May, 2019, the new Tribes Advisory Council for the State of Telangana has to be constituted in terms of Government orders issued in the reference .  Accordingly, in the reference the Commissioner of Tribal Welfare, TS, Hyderabad has submitted proposals requesting the Government to constitute new Tribes Advisory Council.

4) The Non-Official Members of the Telangana State Tribes Advisory Council shall be eligible to draw TA/DA as per Annexure-VI (Rule-91) Para 5 (Miscellaneous) of Telangana State Travelling Allowances Rules, 1996. The Commissioner of Tribal Welfare, Telangana State shall be the Controlling Authority for the purpose of countersigning the TA bills of the Non-Official Members of the Council.
5) The expenditure on the Council shall be debited to the following head of account.

6) The term of the Council shall be for a period of three years from 08.08.2019 or till the date on which the Telangana State Legislative Assembly is first summoned to meet after the next General Elections, whichever is earlier.

Government after careful examination of the matter and in exercise of the powers conferred under Rule (3) of the Telangana State Tribes Advisory Council Rules, 2014 issued in the ref.2nd read above, hereby constitutes the Telangana State Tribes Advisory Council for a period of (3) years from 08.08.2019 with the following (5) Officials and (15) Non-Officials to be the Members of the Telangana State Tribes Advisory Council:

Strength of the Council: The Telangana State Tribes Advisory Council (herein after referred to as the council) shall consist of twenty members, of whom not less than fifteen shall be representatives of the Scheduled Tribes in the Telangana State Legislative Assembly.

Provided that if the number of representatives of the Scheduled Tribes in the Telangana State Legislative Assembly is less than fifteen, the remaining seats shall be filled by other members of these Tribes.

Mode of appointment of members:

The members of the Council shall be appointed by the Governor by notification in the Telangana State Gazette. (i). Terms of office of members:

The term of the Council shall ordinarily be three years

Provided that the terms of the first of a subsequent council shall, where there is a general election to the Telangana State Legislative Assembly, terminated on the date on which the said Assembly is first summoned to meet after the general elections.

Provided also that a member of the Telangana State Legislative Assembly shall vacate his office in the Council if he ceases to be a member of that Assembly.

ii. A member of the council shall also cease to hold office. if he absents himself from three consecutive meetings of the Council provided that when a person who ceased to be a member by reasons of such absence, applied for a restoration within one month from the date of the last of three meetings, the council may, at the meeting next after the receipt of such application, restore him to his office of member but a member shall not be restored more than twice during his term of office. If he resigns his office by giving notice in writing to Government.

Chairman of the Council:

The Minister in-charge of the welfare of Scheduled Tribes shall be the Ex-officio Chairman of the Council.

Performance of the duties of the Chairman in his absence:

In the absence of the Chairman of the Council from any meeting of the Council, such member of the Council as may be determined by the Council shall act as Chairman. 

Appointment of Secretary:

The Commissioner of Tribal Welfare who is in-charge of the administration and control of Scheduled Areas and scheduled Tribes or such other Officer as the chairman of the Council may from time to time specify shall be the ex-officio Secretary to the Council.

Appointment of other officers and servants:

There shall be appointed such other officers and servants to the council as may, from time to time, be determined by the Governor by Special Order.

Matters on which advice of the council is to be sought:-

The Governor may require the advice of the Council on any matter pertaining to the Welfare and advancement of the Scheduled Tribes in the Telangana State, and without prejudice to the generality of the foregoing power, such matters may include:- all new major schemes of welfare and advancement of the Scheduled Tribes in the State; and all cases in which regulation is proposed to be made by Governor under Paragraph 5(2) of the Fifth Scheduled to the Constitution.

Meeting of the Council:

  The Council shall meet as often as may be necessary and, in any case, not less than twice every year

Power of Chairman to invite other persons to participate in the debates of the Council:-

 The Chairman may invite any other person to participate in the debates of the council, but such person shall not have the power of voting.

Traveling Allowance of members:

The Members of the Council, whether they are members of the Telangana State Legislative Assembly or not, shall be eligible for such traveling allowances as may, from time to time, be prescribed by the State Government for the members of First Class General Committees.

 Provided that in no case shall a member of the council who is also a member of the Telangana State Legislative Assembly be entitled to traveling allowances both as a member of the Telangana State Legislative Assembly and as a member of the Tribes Advisory Council.

12. A inserted as per instructions issued in Government. Memo. No. 51/HH2/62-25 Education dated 10.12.63 (Vide D.Dis. No. 29555/63 Dt: 2.1.1964).

AMENDMENT

In the said rules after rule 12 the following rules shall be inserted, namely:-

A. Traveling allowances of Special invitees:-

 The persons who are invited to participate in the debates of the council, whether they are members of the Telangana State Legislative Assembly or not shall be eligible for such traveling allowances as may from time to time, be prescribed by the State Government for the members of the First Class General Committee.

 Member of the Telangana State Legislative Assembly be entitled to Traveling allowance both as an invitee to the said Council and as a member of the Legislative Assembly.

Agenda of the Council:-

A notice containing the agenda for each meeting shall be circulated by the Secretary to the Council, to the Members of the Council at least fifteen days before the date on which such meeting is to be held. With each notice, the Secretary shall whenever it is possible furnish or circulate to each member, copies or originals relevant portions relating to each item of business or a precise thereof.

Provided that in case of urgency meeting of the council may be called on such shorter notice as may be deemed necessary the period of such notice not being less than seven days, after obtaining the prior approval of the Chairman of the Council. (G.O. Rt. No. 876, Revenue dated: 11.10.1969)

Quorum:

 Twenty five percent of the total number of members (excluding the Chairman) of the Council shall constitute a quorum for the meeting of the council and if, at any time there is no quorum for the meeting of the council, the meeting shall be adjourned to such date as may be fixed by the Chairman.

Determination by the majority of Votes:

 The advice of the council on any matter placed before it shall be determined by a majority of voters of the members present and voting at a meeting.

Provided that in the case of an equality of votes the Chairman or person acting as such shall have and exercise a casting vote in addition to his own vote.

Form of decision and opinion of the Council:

 The decisions and opinion of the council on matters referred to them by the Governor shall be in the form of recommendations, but any member may, within Twenty four hours, submit a minute of dissent in regard to any recommendations adopted by the Council and such minute shall be added to and form part of the proceedings of the meeting.

Record of Proceedings of the Council:

 A record of proceedings of each meeting of the council shall be drawn up and entered in a book to be kept for the purpose and it shall be signed by the Secretary, copies

GO 375 on 16 August 2019 Operational guidelines in respect of Retail Outlets (ROs) to be established by the A.P. State Beverages Corporation Limited. Grant of exclusive privilege to run Retail Shops – Excise Policy for 2019-20

PROHIBITION & EXCISE POLICY FOR 2019-20 FOR DISPOSAL OF RETAIL LIQUOR OUTLETS(ROs) TO BE ESTABLISHED BY THE A.P. STATE BEVERAGES CORPORATION LIMITED

 The Government, after careful examination of the proposal submitted by the MD, APSBCL, hereby formulate the following Excise Policy for 2019-20 in respect of Retail Outlets (ROs) to be established by the A.P. State Beverages Corporation Limited.

1.0 NUMBER OF SHOPS :  

1.1. The Government have fixed (3500) A4 Shops for 2019-20.

1.2. The Commissioner of Proh. & Excise will fix unit-wise number of Shops for each unit i.e. Municipal Corporation, Municipality and Mandal and communicate the same to the M.D., APSBCL.

Excise Policy for 2019-20 in Telugu

2.0 LOCATION OF THE RETAIL OUTLETS & SELECTION OF PREMISES :  

The A.P. Excise Act, 1968 and the Rules made there under shall govern the selection of premises for establishment of Retail Outlets. 

3.0 NORMS FOR HIRING PREMISES FOR RETAIL OUTLETS :  

3.1. The premises shall have a minimum space of 150 Sft and a maximum of 300 Sft. It shall be on the ground floor with road frontage, with a provision of single entry and exit, secured walls and pucca construction with permanent fixtures. 

3.2. It shall have adequate number of ceiling fans, tables, chairs, iron racks, electrical sub meter, a bottle cooler and a board for displaying MRPs.

3.3. A Sign Board depicting “APSBCL Retail Outlet – Number_” (in Telugu and English) shall be fixed.

3.4. Other Requirements: Each Shop shall be provided with a Cash Chest and fake note detector.

3.5. The Shop shall be equipped with necessary hardware and software to implement HPFS and inverter.

3.6. (2) CC Cameras in each Shop shall be installed.

4.0 HIRING OF SHOP PREMISES FOR RETAIL OUTLETS:  

4.1. After obtaining approval of the Joint Collector concerned, the Depot Manager designated as Nodal Officer shall give a press advertisement in the district editions of (2) Telugu dailies inviting quotations from the premises owners.

4.2. The model press advertisement will be issued by the M.D, APSBCL, Vijayawada.

4.3. Wide publicity shall be given by displaying the notification at public places like IMFL Depots, Prohibition & Excise Stations, Prohibition & Excise Superintendents Offices, Tahsildar offices, MPDO offices, etc. 

4.4. (7) clear days from the date of notification shall be given for filing quotations.

4.5. The form for quotation of the Shop rent will be communicated by the M.D, APSBCL, Vijayawada. 

5.0 FIXATION OF RENT:  

5.1. The monthly rent quoted should be a lump sum figure including property and all other Taxes for the entire shop space.

5.2. Three months advance rent shall be paid on entering into agreement.

5.3. Electricity and water consumption charges shall be paid by the APSBCL.

5.4. Rental period will be one year, further extendable from time to time.

5.5. The APSBCL reserves the right to vacate the premises with one month notice.

5.6. The District Level Committee, for scrutiny and selection of the shop premises based on the most competitive bid shall consist of the following: 

(a) Joint Collector                            : Chairman 
(b) Deputy Commissioner of P&E     : Member 
(c) P&E Superintendent concerned    : Member 
(d) Proh. & Excise SHO having          
     jurisdiction over the Shop           : Member
(e) The Depot Manager concerned   : Member

5.7. The District Level Committee shall conduct negotiations in a transparent way with the premises owners for arriving at the lowest quotations and fix the monthly rents for the Shops.

6.0 MAN POWER :  

6.1. The following shall be the staffing pattern for the Retail Outlets :

6.2. Remuneration :

Remuneration to Shop supervisor shall be Rs.17,500/- and to Shop salesman Rs.15,000/- Plus PF & ESI as per G.O.Ms. No. 151, Finance (HR-I – Pig. & Policy) Department, dt: 8-8-2016. Remuneration to watch & ward shall be as per G.O.Ms.No.43, Labour Employment Training and Factories (LAB.II) Dept. dated 28.05.2010. The expenses towards cleaning and upkeep shall be met through contingency fund. 

6.3. Age and Qualifications:

The following shall be the age, qualifications, etc.

7.0 METHOD AND CRITERIA FOR SELECTION OF RETAIL OUTLET STAFF:

7.1 The SS / SSM required for Retail Outlets shall be deployed on contracting / outsourcing basis as per the existing Government Orders.

7.2 Watch & ward shall be outsourced through reputed Security Services agencies.

7.3. The reservation percentage of different communities shall be followed.

7.4 The District concerned shall be taken as unit for the purpose of calculating reservation percentages.

8.0 TENURE OF APPOINTMENT, TRAINING & LEAVE:  

8.1 The appointments are purely on contracting / outsourcing basis and are valid for one year only. Further extension of tenure will be decided by the APSBCL.

8.2 The candidates appointed shall undergo training as prescribed by the APSBCL.  

8.3 The candidates shall furnish an undertaking that they will not ask for permanency, regularization or preference in Corporation employment/ recruitment by virtue of their being employed on contracting / outsourcing basis.

8.4 The Shop Supervisor (SS) and Shop Salesmen (SSM) shall give at least one month advance notice in writing to the concerned Depot Manager in case they intend to quit. The Corporation reserves the right to terminate the services of Shop Supervisor (SS) or Shop Salesmen (SSM) at any point of time. 

8.5 If they leave the Job without giving advance intimation and such absence results in any loss to the Corporation, the candidate will be held responsible for such loss.

8.6 Weekly holiday for the employees working at Retail Outlets may be arranged among themselves subject to the approval of Depot Manager concerned.

8.7 The Shop Supervisor and the Shop Salesmen, on completion of one year’s satisfactory service, will be rewarded in the second year with one month’s remuneration as bonus.

9.0. INDEMNITY BOND :

The selected applicant shall submit an indemnity bond communicated by the APSBCL to indemnify any loss sustained by the Corporation on account of negligence or irregularities / violations committed by him.

10.0. TERMINATION OF SERVICES :

In case the Shop Supervisor / Shop Salesman is found guilty of negligence or irregularities / violations, his services are liable to termination by the Depot Manager concerned without assigning any reasons what so ever. Besides, criminal proceedings shall be launched against the guilty as per Law.

11.0 DUTIES & RESPONSIBILITIES

11.1 Shop Supervisor (SS): a) Overall Supervision of day-to-day

transactions. b) Maintenance of registers, stocks c) Placing indents            d) any other duties assigned by Depot Manager.

11.2 Shop Sales Men (SSM): a) Loading of bottles into the shelves b) Delivery of bottles to customers as per the bill c) Issuing of bills to the customers d) any other duties assigned by SS 11.3 Watch and ward: Security during nights.

12.0 The District Level Committee to select the man power on outsourcing basis to work at Retail Outlets, shall consist of the following: 

  • Joint Collector: Chairman 
  • Deputy Commissioner of P&E: Member 
  • District Manager /

     Zonal Manager concerned             : Member  (d) Depot Managers, concerned                   : Member

                            (e) Nodal Depot Manager: Convener

13.0 JOB CHART:  

13.1. The shop shall be kept open, on all days except dry days, from 10.00

A.M. to 9.00 P.M, as prescribed in the Rules.

13.2. Shop Supervisor (SS) and Shop Sales men (SSM) should sell the stock of IMFL/FL/Beer etc., at the MRP rates only as fixed by the Government. 

13.3 Shop Supervisor / Shop Sales men should not sell liquor / Beer to any persons below 21 years of age and sale of number of liquor/beer bottles shall not exceed the maximum possession limit prescribed under the A.P. Excise Act, 1968. 

13.4 The sale of IMFL/FL/Beer in retail outlet shall be in First-In-First-Out (FIFO) basis. The Shop Supervisor / Shop Salesmen are responsible for following FIFO method in selling IMFL/FL/Beer in respect of each brand.

13.5. The Shop Salesmen shall handle the liquor/beer stocks carefully and responsibility for breakages in the Shop shall rest with the Shop Salesmen.

13.6. Shop Supervisor / Shop Salesmen shall issue bills to the customers.

They are responsible for bank remittance of sale proceeds, placing of Indents with the Depot, maintenance of registers / records relating to cash, stock, etc. 

14.0 CONTRACT FOR TRANSPORTATION OF IMFL & FL FROM DEPOT TO RETAIL OUTLETS:  

14.1 The Committee for the fixation of Transportation charges shall consist of the following:

  • Deputy Commissioner of P&E                     : Member 
  • District Manager / 

                                 Zonal Manager concerned                       : Member

  • The Nodal Depot Manager after obtaining approval from the Joint Collector shall issue a press advertisement in two district editions of Telugu daily newspapers inviting quotations.
    1. The Committee shall negotiate with the applicants, arrive at the lowest competitive quotations and fix the transportation charges.
    1. The transportation charges shall be inclusive of loading at Depot level and unloading at APSBCL retail outlet.
    1. The transporter shall be responsible for breakages / damages during transit.

15.0 INSURANCE: 

Stock of IMFL, FL and cash in respect of Retail Outlets shall be insured.

16.0  AGREEMENTS 

After the approval of the Committee concerned, the Depot Manager concerned shall enter into agreements with the owners of the shop premises, transporters and contracting / outsourcing agencies.

17.0  Auditing

The M.D., APSBCL shall take necessary action for conducting both internal and external audit of the accounts, stocks, cash and other transactions relating to Retail Outlets on regular basis.

18.0 Relaxation of the norms

In exceptional cases, the M.D, APSBCL may relax the norms fixed above in respect of any item, for a period not exceeding one year, to meet administrative exigencies and ensuring smooth functioning of APSBCL Retail Outlets.

19.0 COMPLIANCE 

The above instructions shall be followed scrupulously without any deviation. 

2.         The MD, APSBCL, Vijayawada, shall take necessary action accordingly in the matter.

Modalities on Reverse tendering process in Andhra Pradesh

GO 67 on 16 August 2019 Water Resources Department – Modalities to be implemented on Tendercum-reverse auctioning process or Reverse tendering process for the ongoing works and tendering process for fresh works –Orders – Issued.

i) The guidelines are intended to be applicable for contracts where the Government is desirous of discovering a fair price through a competitive bidding process for the execution of ongoing projects. In this process it should be ensured that the prevailing terms and conditions of the contract remain unchanged besides a seamless transfer of responsibilities between the Contractors/ Agencies.

ii) Before initiating the process of tender-cum-reverse auctioning for ongoing works for which agreements are in force, invariably the agreement should be terminated under appropriate clause of agreement as there is every chance of existing contracting agencies raising objections for fresh reverse tendering process when their agreements are in force. In this regard, legal opinion may be obtained, if required, before initiating the termination of the existing agreement for avoiding legal complications.

iii) After terminating the existing work, the estimated value of the balance work have to be prepared with the original agreement rates which will become the Initial Bench Mark (IBM) value / Estimated Contract Value (ECV) on which tender-cum-E Auction (reverse tendering) shall be proceeded. It should be existing agreement value minus value of work done that would become the ECV of Reverse bidding.

iv) The prequalification criteria may be revised suitably as per standard guidelines stipulated in G.O. Ms. No. 94, I&CAD (PW Code) Dept. Dt.
01.07.2003 to ensure larger participation.

v) Restriction clause like Registration in Andhra Pradesh may be relaxed. JV as well as MoU with combined bid capacity may be encouraged to ensure larger participation.

vi) If sufficient competition is not expected, feasibility of splitting-up/clubbing the balance work terminated from original agency into smaller/larger packages can be examined to encourage more number of bidders.

vii) The existing contractor may also be given a chance to participate in the tender-cum-reverse auctioning process.

viii) Pre-qualification criteria i.e., a pre-determined threshold for the technical and financial criterion shall be finalized by the department considering the “balance work” of the terminated contract.

ix) All bidders shall self-declare their details under each technical and financial criterion on the e-procurement platform along with an undertaking confirming their compliance with the technical and financial criterion prescribed in the bid document.

x) All bidders shall submit supporting documents for their submittals under each technical and financial criterion. In case of documents found to be defective, incorrect or forged and therefore claim of qualification is not supported, severe action including forfeiture of EMD shall be taken.

xi) The existing online e-procurement system shall be revamped in a such a way that the system should be able to filter the qualified bidders and enable them to quote their price bids and also allow them to participate in e-auction process.

xii) The threshold values of Technical and Financial qualification as prescribed by the department shall be displayed to the bidders on the screen of online e-procurement site. The bidders have to submit their details of qualification criterion in prescribed text boxes along with their self-declaration on the fulfilment of qualification criterion prescribed. The system automatically evaluates the qualification details uploaded by the bidders and enable the qualified bidders only to quote for their price bid in the prescribed box for the work.

xiii) All bidders satisfying pre-qualification criterion as per their submittals and self-declaration on e-procurement site shall quote their price offer.

xiv) The Price bids of all the bidders shall be opened and the lowest quoted price bid among the qualified bidders in the tender process shall be determined.

xv) To conduct the reverse tender process at least two bidders would be required.

xvi) The L1 Price Offer (Initial) shall be the maximum allowable Bid price for the reverse tendering process.

xvii) Only one round of reverse tendering shall be carried out in which bidders can revise their bids multiple times within the time limits specified.

xviii) At the start of the Reverse Tendering process the Maximum Allowable Bid Price will be set and bidders shall submit their bids in an online platform.
xix) Names of the bidders / vendors shall be anonymously masked in the Reverse Tendering process and vendors will be given suitable dummy names.

xx) The initial period of the Reverse tendering process will start after
3 hours, following which there will be auto extensions of time by 15 minutes in case of any reduction in bids recorded in the prior 15 minutes.

xxi) Only the current L1 bid shall be visible to all bidders who may revise their bids until the end of the process.

xxii) Decrements made in each subsequent bid shall not be less than
0.5% of the IBM/ECV uploaded.

xxiii) The L1 bid may be determined following a period of inactivity of more than 15 minutes of reverse bidding after the initial 3 hour period after closure of the main bidding.

xxiv)Following the determination of the L1 bid, the L1 bidder’s supporting documents under each technical and commercial criterion shall be verified. The reverse tendering process shall be on hold for a maximum period of 24 hours (1 day) while the L1 bidder’s supporting documents are verified.

xxv) Upon successful verification of the L1 bidder’s supporting documents, the reverse tendering process shall be closed declaring the L1 bidder as “successful bidder” and the remaining bidders in the process shall be notified as “unsuccessful” and their respective EMDs shall be refunded.

xxvi) In case there are discrepancies between the L1 bidder’s declarations under the technical and financial criteria and the supporting documents submitted, the L1 bidder shall be disqualified, his EMD shall be forfeited, he will be removed from the reverse tendering process and the remaining bidders shall be notified of the date and time when the reverse tendering process shall be resumed.

xxvii)The reverse tendering process shall be resumed with the L2 price as the Maximum Allowable Bid Price.

xxviii)Only 15 minutes shall be initially allowed for the remaining bidders to revise their bids, subject to automatic extensions of 15 minutes in case of any reduction in bids recorded in the prior 15 minutes.

xxix)The reverse tendering process shall continue until the determination of a successful bidder.

xxx) The above conditions are for cancelled bids, but with modifications this can be used for fresh works also.

xxxi)Government in Water Resources Department is competent to issue any clarification if required. All works departments may adopt the above procedure of reverse tendering.

After careful examination of the matter, Government hereby rename the “Chandranna Pelli Kaanuka” as “YSR Pelli Kaanuka”.

Eligibility Conditions:

The eligibility conditions for availing the scheme are as mentioned hereunder:

a) Bride shall be an unmarried woman and belong to the SC community. Thewidows belonging to the SC community are also eligible under the scheme.
b) Bridegroom shall never have been married.
c) Bride shall have completed (18) years of age and the bridegroom shall have completed (21) years of age, as on the date of marriage.
d) Bride and bridegroom shall be residents of Andhra Pradesh.
e) Bride shall belong to family having annual income Below the Poverty Line.
f) Marriage shall be performed in Andhra Pradesh
g) Bride & bridegroom shall have passed Class X. However, this condition shall be relaxed for marriages conducted up to and no later than June 30th, 2020.

In order to ensure the smooth functioning of the YSRPK-SD, the following orders have been issued regarding the funds drawal & release related to YSRPK, vide Para 17 of the reference read above:

a) Creation of a Dedicated Pool Account to be maintained by the Society for
Elimination of Rural Poverty (SERP) for the purpose of release of (i) Marriage Incentive (ii) Field Verification Fee & (iii) Marriage Verification Fee.

b) Creation of a separate account with the State Level Nodal Officer, YSRPKSD i.e the Director of Social Welfare for the crediting of the Administrative Costs from all the concerned Departments related to the MRIS for incurring the expenditure towards the administrative costs/release of administrative costs to the concerned implementing agencies.

Inter Caste Marriage Schemes:

For inter caste marriages, the bride and the bridegroom shall either be from different castes or if they are from
the same caste, they shall be from different subcastes;
YSR Pelli Kaanuka (DifferentlyAbled): Either one or both of the bride or bridegroom shall be disabled, with the permanent
disability percentage being at least 40%;
YSR Pelli Kaanuka (SCs): Bride shall be from SC community;
YSR Pelli Kaanuka (BCs): Bride shall be from BC community;
YSR Pelli Kaanuka (Giriputrika): Bride shall be from ST community;

At Para 17 of the reference read above, the need to define a bespoke financial management structure for timely transfer of funds from various Welfare Departments implementing the MRIS to the SERP Pool Account, has been envisaged.

In furtherance of the same and in view of the learnings obtained from the implementation of the YSRPK so far, the following operational guidelines for Fund Management for the smooth functioning of the YSRPK-SD are issued:

6.1. TRANSFER OF MRIS FUNDS FROM PARTICIPATING DEPARTMENT TO NODAL PD ACCOUNT:

6.1.1. : The State Level Nodal Officer, YSRPK-SD i.e the Director of Social Welfare shall open an exclusive PD Account into which the MRIS funds from all the departments participating in YSRPK-SD shall be channelized. This account shall be called the Nodal PD Account.

6.1.2. The Nodal PD Account shall have (2) sub-ledgers, one for Programmatic Funds i.e. for Marriage Incentive, Field Verification Fee and Marriage Verification Fee related payments and the second for Administrative Costs.
6.1.3.: The Departments participating in the YSRPK -SD shall prefer the bill to Pay & Account Officer/Treasury to draw the stipulated amount and shall adjust the same to the Nodal PD Account.

6.1.4.: The Finance Department shall allow the drawal of the funds by the Departments participating in the YSRPKSD to be adjusted to the Nodal PD Account, on a quarterly basis. However, the quarterly regulation shall be relaxed on a case-to-case basis, based on the requirement of additional funds. In this regard, the Marriage Related Incentive Schemes covered under the YSRPK-SD, not having a Grant-in-Aid Head of Account (310-Grants-in-Aid, 312-other Grants-in-Aid) shall also be permitted to adjust their funds to the Nodal PD Account and the Finance Department will issue the enabling orders in this regard, duly covering the aspect of re-appropriation of balance funds for the Financial Year 2018-19, from the existing non-Grant-in-Aid Head of Account/s to the Grant-in-Aid Head of Accounts that will now be required to be created.

6.1.5. : The State Level Nodal Officer, basing on the expenditure incurred under the schemes and the expenditure forecast based upon the applications received may request the concerned Department to fund the scheme account in relaxation of the quarterly regulations and in such case the concerned Department shall take action for the release of the funds accordingly.

6.1. 6.: Retaining 5% Funds towards Administrative Costs: From the funds adjusted to the Nodal PD Account by various participating departments, the Nodal Officer, YSRPK-SD shall retain 5% of funds, as permitted in the para 14.3 of reference read above, in the ‘Administrative Costs’ sub-ledger of the Nodal PD Account, to be expended towards Administrative Costs.

6.2. TRANSFER OF FUNDS FROM NODAL PD ACCOUNT TO SERP POOL ACCOUNT

6.2.1. : The CEO SERP shall open an exclusive bank account for the scheme, called ‘SERP Pool Account’.

6.2.2. After retaining the 5% funds for Administrative Costs as mentioned above, the State Level Nodal Officer, YSRPK-SD shall transfer the balance 95% of Marriage Related Incentive Scheme Funds credited into the Nodal PD Account, to the pool account maintained by SERP for YSRPK-SD, to be expended towards Marriage Incentive, Field Verification Fee and Marriage Verification Fee.

6.2.3. : The State Level Nodal Officer, YSRPKSD shall transfer the funds to the SERP Pool Account as per the requirement on a monthly basis and place the funds STRICTLY equivalent to one-month requirement in advance.

6.2.4. : The Finance Department shall issue the enabling orders to ensure that there are no quarterly restrictions on the Nodal PD Account to transfer the funds to the SERP Pool Account.

6.2.5. : The funds shall be placed basing on the expenditure incurred under the SERP Pool Account and the expenditure forecast based upon the applications received.
6.2.6. : The CEO, SERP is authorised to utilise the funds placed in the SERP Pool account for Marriage Incentive, Field Verification Fee and Marriage Verification Fee to the concerned beneficiaries/ field personnel under all the schemes covered under YSRPK-SD on a First-Sanctioned-First-Paid-basis.

NODAL OFFICER’S ROLE IN FUND MANAGEMENT:

1.: The State Level Nodal Officer, YSRPK-SD shall discharge the following responsibilities with respect to fund management:

a) Make monthly, quarterly and annual forecast of the anticipated expenditure under various schemes covered under YSRPK-SD.
b) Closely watch the trend of scheme-wise applications being sanctioned.
c) Requisition additional funds from the departments participating in YSRPKSD based on the above two factors and on annual physical and financial ceilings of various schemes.
d) Arrange to maintain the scheme wise accounts pertaining to crediting into and debiting from the Nodal PD Account, the Marriage Related Incentive Scheme funds.
e) Arrange to provide requisite reports for scheme-wise reconciliation of funds
f) Arrange to provide a Fund Management Dashboard to all the participating departments
g) Arrange to furnish Scheme Wise Utilisation Certificates.
h) Make arrangements for the concurrent audit of the scheme by engaging certified audit agencies.

  1. The above orders shall come into force w.e.f. October, 01, 2018.
  2. The Director of Social Welfare (State Level Nodal Officer, YSRPK SD), Director of Tribal Welfare, Director of BC Welfare, Commissioner of Minorities Welfare, Spl. Commissioner of Differently-Abled Welfare and CEO, APBOCWWB shall take necessary action in the matter.
  3. The CEO, APCFSS shall make changes in the software application, as necessary.

Telangana State Council on Older Persons under Senior Citizens Rules Whereas, by section 101 of the Andhra Pradesh Re-Organization Act, 2014 (Central Act No. 6 of 2014) the appropriate

Government i.e., the State of Telangana is empowered by order, to make such adoptions and modifications of any law made before 02-06-2014, whether by way of repeal or amendment as may be necessary or expedient, for the purpose of facilitating the application of such law in relation to the State of Telangana, before expiration of two years from 02-06-2014, and thereupon every such law shall have effect subject to the adaptions and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority; 2. And whereas, it has become necessary to adapt and modify the Andhra Pradesh

Maintenance and Welfare of Parents and Senior Citizens Rules, 2011 are in force as on 01-06-2014 for the purpose of facilitating its application in relation to the State of Telangana;

Accordingly, the following notification will be published in the Extra-ordinary issue of the Telangana Gazette Dt:30-05-2016.

In the Andhra Pradesh Maintenance and Welfare of Parents and Senior Citizens Rules, 2011 throughout the Rules for the words “Andhra Pradesh” occurring otherwise than in a citation or description or in the title of other enactments, the word “Telangana” shall be substituted.

Government of India have enacted the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (Central Act No.56 of 2007) for the maintenance and welfare of parents and Senior citizens.

The erstwhile State Government have notified the Maintenance and Welfare of Parents and Senior Citizens Rules, 2011 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 in exercise of the powers conferred by sub section (1) read with sub section (2) of section 32 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007(Act No.56 of 2007). The same have been adapted to the Telangana State by issuing a notification vide reference 3rd cited.

Under Rule 22 of the “AP Maintenance and Welfare of Parents and Senior Citizens Rules” the State Government issued orders for constituting a State Council on Older Persons for Implementation of National Policy on Older Persons under the Chairmanship of Hon’ble Minister for Women, Children, Disabled and senior Citizens for a period of one year vide references 4th to 6th read above from time to time. The tenure of the State Council of Senior Citizens committee has been expired on 02.04.2019.

Government after careful examination in the matter and in order to implement the Maintenance and Welfare of Parents & Senior Citizens Act, 2007 and as per rule 22 of A.P Maintenance of Parents and Senior Citizens Rules, 2011 hereby re-nominate the following members to the State Council on Older Persons Committee in Telangana State for one more year w.e.f. 03-04-2019.

PROHIBITION & EXCISE POLICY FOR 2019-20 IN RESPECT OF SHOPS (RETAIL OUTLETS)

Excise Policy for 2019-20 RETAIL OUTLETS The Government, after careful examination of the proposal submitted by the Commissioner of Prohibition & Excise, Andhra Pradesh, hereby formulate the following Excise Policy for 2019-20 in respect of retail liquor Shops.

  • The number of Shops fixed for 2019-20 is (3500).
  • The licence period of the Shops shall be from 01.10.2019 to 30.09.2020.
  • The A.P. State Beverages Corporation Limited (APSBCL) is granted exclusive privilege of selling by Shop and accordingly the APSBCL shall run the retail Shops all over the State from 01.10.2019.
  • The Commissioner of Prohibition & Excise shall fix the number of Shops to be established in a Village/Nagar Panchayat/ Municipality/Municipal Corporation having due regard to the requirement, public order, health, safety and other factors as he thinks fit.
  • While establishing the Shops, the directions of the Hon’ble Supreme Court of India issued from time to time on the sale of liquor on Highways shall be strictly followed.
  • All the Shops in the State shall be equipped with the required machinery for implementation of Hedonic Path Finder System (HPFS) and for reading of Holographic Excise Adhesive Labels (HEAL).
  • Each Shop shall be equipped with CC cameras.
  • No Shop shall be permitted on the road from Tirupathi Railway Station to Alipiri via RTC Bus Stand, Leelamahal circle, Nandi circle, Vishnu Nivasam, Srinivasam. Likewise, no Shop shall be permitted on the road from Leelamahal – Nandi circle – Alipiri – SVRR Hospital – SVIMS in Tirupathi Municipal Corporation area.
  • The provisions contained in the A.P. Excise (Grant of licence of selling by shop and conditions of licence) Rules 2019, as may be amended from time to time, shall govern the establishment and operation of the Shops by the APSBCL.
  • The Enforcement wing shall be strengthened for effective control of all Excise offences including un-authorised sale outlets (Belt shops).
  • The Health, Medical & Family Welfare Department is directed to establish one de-addiction centre in every district in the State.
  • Intensive campaign to educate the public about responsible drinking and the evil effects of irresponsible drinking may be taken up.

1. Short title, extent, commencement and application:-

  • These rules may be called the Andhra Pradesh Excise (Grant of licence of selling by Shop and conditions of licence) Rules, 2019. 
  • They shall extend to all the areas where the Andhra Pradesh Excise Act, 1968 is in force. 
  • They shall come into force w.e.f. 01.10.2019.

These rules shall apply for the grant of licence for selling IMFL and FL in retail by Shop, conditions governing such licence and transport of IMFL and FL by such licence holder. 

2. Definitions:-

   1) In these rules unless the context otherwise requires, 

  • “Act” means the Andhra Pradesh Excise Act, 1968, Act No.17 of 1968. 
  • “APSBCL” means the Andhra Pradesh State Beverages Corporation Limited.
  • “Dry day” means a day on which no liquor shall be sold  in the licensed  premises;
  • “Holographic Excise Adhesive Label” means the label designed and approved, printed and supplied under the supervision and control of the Commissioner of Prohibition and Excise, from time to time in different forms for the purpose of its affixture to sealed bottles of different varieties and sizes containing liquor.
  • “Foreign Liquor”, referred to as “FL”, means every liquor imported into India, other than the Indian Made Foreign Liquor;
  • “Form” means a form appended to these Rules;
  • “Government” means the State Government of Andhra Pradesh
  • “Highway” means a National highway or a State highway as notified by the competent authority.
  • “Indian Made Foreign Liquor”, referred to as “IMFL” means Liquor produced, manufactured or compounded in India after the manner of Gin. Brandy. Whisky or Rum imported from foreign countries and includes Wine and Beer and Milk Punch and other liquors consisting of or containing any such spirits but does not include foreign liquor.
  • “Licence” means a licence issued under these Rules:
  • “Licensee” means holder of such licence.
  • “Licensing Authority” means the Commissioner of Prohibition and Excise.
  • “Licence Fee” means the annual licence fee prescribed under these Rules.
  • “Licence period” means the period of twelve months commencing from 1st October and ending on 30th September or part thereof. 
  • “Licensed premises” means a premises where IMFL and FL are permitted to be sold by the Licensee.
  • “Maximum Retail Price” (MRP) means the price indicated by the Andhra Pradesh State Beverages Corporation Limited or any other agency authorized by the Government for declaration on each variety of label by the Manufacturers of Indian Made Foreign Liquor as required under Section 39 of the Standards of Weights and Measures Act, 1976 read with clause (r) of rule 2 of the Standards of Weights and Measures (Packaged Commodities) Rules, 1977.
  • “Permit” means a permit issued under these rules.
  • “Population” means the figure of population as officially published in the latest census. 
  • “Scheduled Areas” means the Scheduled Areas notified under paragraph 6  of the Fifth Schedule of the Constitution of India  
  • “Shop” means a privilege granted under these rules for sale of Indian Made Foreign Liquor or Foreign Liquor in sealed or capsuled bottles or packages or tins to an individual in quantities not exceeding the limits as prescribed without permitting consumption on the licensed premises. 
  • “Sealed” in relation to the bottles containers or other receptacles means closed  with a capsule and wrapped by wire or closed with a cork or lid and Wrapped with a lining around it.
  • “Transport Permit” means a permit issued by the competent officer for transport of IMFL and FL from the A.P.S.B.C.L. Depot / Government Wholesale Depot or the Depot of any other Corporation owned by the State Government to the licensed premises.
  • “Village/ Town/ City etc.” shall mean Village/ Town/ City as defined in the          latest census.  

 2) The words and expressions used but not defined in these rules shall have the same meanings assigned to them in the Andhra Pradesh Excise Act, 1968 and Andhra Pradesh Excise (Import, Export and Transport of Indian Made Foreign Liquor and Foreign Liquor – Permits) Rules, 2005. 

3. Establishment of Shops:-

Subject to such directions, which the Government may issue in this regard from time to time, the Commissioner of Prohibition and Excise, having due regard to the requirement, public order, health, safety and other factors as he thinks fit, may fix the number of Shops to be established in a Village/Nagar Panchayat/ Municipality /Municipal Corporation.

4. Application for Grant of Licence:-

  • The A.P. State Beverages Corporation Limited or any other Corporation wholly owned and controlled and authorized in this behalf by the Government shall make an application in form A-1 to the Commissioner of Prohibition and Excise for grant of licence of selling by Shop.
  • The application shall be accompanied by a Treasury Challan for the annual licence fee.

5. Grant of Licence:-

On application, the Commissioner of Prohibition and Excise shall grant Licence in form A-2 for sale of IMFL and FL in retail.

Provided that no Shop Licence shall be issued in Scheduled Areas unless the Grama Shabha concerned gives its consent or is deemed to have given its consent to grant such licence to establish the Shop(s). 

Explanation: For the purpose of this proviso, a Gram Sabha shall be deemed to have given its consent to establish the Shop(s) if it fails to indicate its consent or otherwise for establishment of the Shop(s) in the Village concerned within 15 days of seeking the same. 

6. Licence fee:-

The licence fee for the Shop licence in Form A-2 shall be Rs.1,000/- per annum, or part thereof. 

7. Period of the licence and commencement of business:-

Every licence shall be valid for twelve months commencing from 1st October, and ending on 30th September.

Provided that licence holder shall commence his business from 1st October of the licence periodor such other date as may be specified in the licence and shall keep the licensed premises open every day during the hours fixed till the expiry of the term of licence with sufficient stocks of liquor unless the closure of the Licensed premises is ordered by the competent authority for the period specified.

8. Renewal of Licence:- 

Subject to such directions as may be issued by the Government, the Licensing Authority may, on payment of annual licence fee, renew the Licence for a period not exceeding one year.  

9. Selection of Premises:

  • “Subject to the approval of the Commissioner of Prohibition & Excise, the Licence holder shall select suitable premises for sale of IMFL and FL within the Municipal Corporation, Municipality, Nagar Panchayat or Village, as the case may be. It shall be at least 100 meters away from the places of Public worship, Educational Institutions and Hospitals.”
  • “No Shop for the sale of liquor shall be (i) visible from a National or State Highway, (ii) directly accessible from a National or State Highway and (iii) situated within a distance of 500 Mts. of the outer edge of the National or State Highway or of a service lane along the Highway”.

Provided that in case of areas comprised in local bodies with a population of 20,000 or less, the distance shall be 220 meters.

Provided further that the restrictions in sub-rule (2) shall not apply to the Shops established within Municipal areas.

  • No signages and advertisements of the availability of liquor shall be permitted both on National and State Highways.

  Explanation: For the purpose of this rule:

  • “Place of public worship” means a temple registered with the Endowment Department, Mosque registered with Wakf Board and Church established and managed by a registered Christian Organisation / Societyand includes such other religious institutions, as the State Government may by order specify in this behalf; 
  • “Educational Institution” means any Primary school, Middle School and High School recognized by the State Government or Central Government, Junior College or any College affiliated to any University established by law; 
  • “High Way” means National Highway or State Highway as notified by the competent authority;
  • “Hospital” means any hospital which is managed or owned by a local authority, State Government or Central Government or any private hospital and having a provision of at least thirty (30) beds.
  • The distances referred above shall be measured from the mid-point of the entrance of the Licensed premises along the nearest path by which a pedestrian would ordinarily reach the mid-point of the nearest gate of the institution or a place of public worship, if there is a compound wall and if there is no compound wall to the mid-point of the nearest entrance of the

Institution/ Place of public worship.

  • The boundaries of the premises shall be indicated in the licence. 
  • There shall be a single door for entry and exit for the licensed Shop and sales shall be conducted without giving entry to the customers inside the premises.

10. Transport permit:-

Transport permit may be issued authorizing movement of IMFL and FL within the State from the units of the Andhra Pradesh State Beverages Corporation Ltd., / Government Wholesale Depot or the Depot of any other Corporation owned by the State Government to the licensed premises. Such transport shall be governed by Andhra Pradesh Excise (Import, Export and Transport of IMFL and FL – Permits) Rules, 2005. 

11. Shifting of licensed premises:-  

No change or alteration of the licensed premises shall be made nor the licensed premises shifted elsewhere except with the previous permission of the Commissioner of Prohibition and Excise.  

12. Hours of Business:-

The Licensee shall transact business from 10.00 AM to 9.00 PM only. 

13. Dry Days:-

The Licensed premises shall be closed and no business transacted on the following days declared as dry days:- 

  • 26 January -Republic day 
  • 15 August -Independence day
  • 2 October -Gandhi Jayanthi. 

14. Licensee not to stock Indian Made Foreign Liquor or Foreign Liquor at unauthorized place:- 

The Licensee shall not stock IMFL and FL in any place other than the licensed premises. The Shop supervisor, the salesmen or any other person employed by the Corporation shall be held responsible for any IMFL and FL unauthorizedely kept outside or nearby the licensed premises. 

15. Indian Made Foreign Liquor or Foreign Liquor unfit for human consumption to be seized:-

It shall be competent for the inspecting officer, on finding any IMFL and FL unfit for use, substandard, adulterated or spurious or in respect of which it is believed that some substance has been admixed so as to make it unfit for consumption by any process or manner, to stop it from being sold and to seize the same forthwith and take necessary further action as per rules.

The Shop supervisor, the salesmen or any other person employed by the Corporation of the Shop concerned shall be held responsible for dilution or brand mixing of liquor or otherwise rendering liquor unfit for human consumption. 

16. Indian Made Foreign Liquor and Foreign Liquor shall not be given or sold to certain persons:- 

    (1)      No liquor shall be sold or given to the following persons namely:

  • Lunatics; 
  • Persons known or believed to be in a state of drunkenness; 
  • Persons about whom it is known or suspected that they are likely to participate in the commission of sedition, insurrection, breach of peace or any other similar offence threatening public peace and tranquility; 
  • Soldiers in uniform and the camp servants of military officers in their   uniform; 
  • Persons below (21) years of age.

(2) The salesmen or any other person employed by the Corporation of the Shop concerned shall be held responsible for any IMFL and FL sold in contravention of this Rule. 

17. Bottles for sale to carry labels:-

Every bottle of IMFL or FL in a licensed premises shall carry Excise Adhesive label or Hologram on the cap of the bottle in addition to the manufacturer’s label as approved by the Commissioner of Prohibition and Excise. 

18. Maximum Retail Price:-

  • The Licensee shall sell IMFL and FL at prices not exceeding the Maximum Retail Price indicated on the labels of the bottles and issue bills to the customers accordingly. A price list of the brands of IMFL & FL kept for sale shall be displayed in a conspicuous place in the Shop for information of the Public.
  • The Shop supervisor, the salesmen or any other person employed by the Corporation of the Shop concerned shall be held responsible for sale of IMFL and FL at retail prices exceeding Maximum Retail Prices fixed.

19. Employment of servants:- 

  • No woman shall be employed in Retail Outlets. 
  • No person below the age of twenty one years shall be employed for sale of IMFL and FL.
  • Persons convicted of any offence under the Andhra Pradesh Excise Act, (Act of 17 of 1968) or the Narcotics Drugs and Psychotropic Substances Act, 1985 (Central  Act 61 of 1985) within the preceding three years, 
  • Persons convicted under Section 482 to 489 of the Indian Penal Code, 1860 (Central Act 45 of 1860), 

20. Licensee to maintain accounts:- 

  • The Licensee shall maintain full and day to day accounts of IMFL and FL received and disposed of in Form R-1 and daily Brand-wise account in Form R-2, the pages of which are machine numbered serially. 
  • The licensee shall install the required equipment for effective implementation of Hedonic Path Finder System (HPFS) and required machinery for reading of Holographic Excise Adhesive Labels (HEAL).”
  • The Shop supervisor, the salesmen or any other person employed by the Corporation of the Shop concerned shall be responsible for maintenance of accounts for the Shop.

21. Licensee to provide CC Cameras:-

The licensee shall provide required number of CC cameras in the Shop.

22. Officers authorized to inspect premises:-

Any officer not below the rank of a Prohibition & Excise Sub – Inspector may enter and inspect the licensed premises during the working hours and inspect and verify all the accounts, registers and stocks. It shall be competent for such inspecting officer to take such samples as might be necessary, or to take charge of such records and registers as might be necessary. An inspection book in Form I-1 with machine numbered pages shall be kept in the Shop for the use of the inspecting officers.

23. Licensee to abide by the provisions of the Act etc:-  

Every holder of the licence under these rules shall comply promptly with all orders or directions issued from time to time under the Act, and the rules and orders made there under and shall abide by all the conditions of the licence / permit. 

24. Existing Rules cease to operate:-

The A.P. Excise (Grant of licence of selling by Shop and conditions of licence) Rules, 2012 shall cease to operate on the commencement of these Rules.

25. Removal of difficulties:-

600 Crores for Drinking Water Supply Scheme to Uddhanam area of Srikakulam DistrictGovernment have accorded permission to the Andhra Pradesh Drinking Water Supply Corporation (APDWSC) for obtaining loan of Rs.5,330.00 Crores from public sector scheduled banks to take up Drinking Water Supply Projects in (8) Districts viz., Srikakulam, Vizianagaram, Visakhapatnam, East Godavari, West Godavari, Krishna, Guntur and Prakasam out of total project cost of Rs.6,330.00 Crores with following conditions:-

  1. The Loan and Principal Amount are payable by the APDSC and the Govt. Guarantee extended is only for the Principal amount of Rs.5300 crores.
  2. Payment of one time Guarantee Commission of 2% of the Loan Amount to Govt of AP in order to deposit in GRF.
  3. Loans shall be obtained from public sector SCBs and the rate of interest shall be less than or equal to 7.9% annum / as approved by Finance Department and care shall be taken to avoid various penalty clauses for prepayment etc.
  4. In the reference 2nd read above, Government have extended guarantee for interest amount also on loan amount of Rs.5,330.00 Crores on obtaining from public sector scheduled banks to take up Drinking Water Supply Project in (8) Districts viz., Srikakulam, Vizianagaram, Visakhapatnam, East Godavari, West Godavari, Krishna, Guntur and Prakasam District.
  5. Government have accorded administrative sanction for “12 MVS projects for construction of Drinking Water Supply in Srikakulam District” with an estimated amount of Rs.1000.00 Crores.
  6. The Managing Director, A.P. Drinking Water Supply Corporation, Vijayawada has informed that the work was entrusted to M/s L&T Ltd., Chennai on tender basis and later due to vast change in scope of work and financial outlay, the agreement with M/s L&T Ltd., was terminated. He has also informed that Uddanam is a critical area in Srikakulam District where Chronic Kidney disease prevails. The cases are prominent in Ichhapuram, Kanchili, Kavity, Vajrapukothuru, Palasa, Mandasa and Sompeta Mandals. However, scientific reasons could not be identified for occurrence of the disease in these areas. One of the suspected reasons is the water the public is consuming in these areas. The drinking water schemes in this area are ground water based. Hence, it is proposed to provide water to these Mandals through a Multi-Village Scheme with a surface water as source located outside this area.
  7. The Managing Director, A.P. Drinking Water Supply Corporation, Vijayawada has therefore, requested the Government to accord administrative sanction for the work “Providing Drinking Water Supply Scheme to Uddhanam area of Srikakulam District” with an estimated cost of Rs.600.00 crores to Uddhanam area in Palasa and Ichhapuram constituencies of Srikakulam District with Regulapadu Reservoir as source.
  8. Government, after careful examination of the matter hereby accord administrative sanction for an amount of Rs.600.00 crores for the work “Providing Drinking Water Supply Scheme to Uddhanam area of Srikakulam District” to cover 7 Mandals with 807 rural habitations of Uddhanam area, Palasa-Kasibugga and Ichhapuram Municipalities in Palasa and Ichhapuram constituencies of Srikakulam District with Regulapadu Reservoir as source out of the administrative sanction of Rs.1000.00 crores already accorded to Srikakulam District vide G.O
  9. The Managing Director, A.P. Drinking Water Supply Corporation, Vijayawada is hereby authorized to make modifications/alterations in respect of works with reference to the sanctioned works in para-6 above within the project cost of Srikakulam District.
  10. The Managing Director, A.P. Drinking Water Supply Corporation, Vijayawada shall take further necessary action accordingly.

  • The Group of Ministers shall examine the matter of existing policies and evolve new policy for providing House sites to Advocates, Priests, Imams, Pastors, Government Employees, Homeless poor people and Journalists and any other related issues for allotment of land for housing to various categories of people and furnish it’s recommendations to the Government for taking a decision in the matter. 
  • The Spl.Chief Secretary to Government(Land), Revenue Department shall be the Member Convenor of the above Group of Ministers.

Kaleshwaram Irrigation Project Corporation Ltd., Hyderabad Financial Assistance of Rupee Term Loan to KIPCL Ltd., from Rural Electrification Corporation Limited towards Electro- Mechanical, Hydro-Mechanical and associated civil works under 02 schemes of Kaleshwaram Multi-purpose Irrigation Project

Government have issued orders constituting the Kaleshwaram Irrigation Project Corporation (KIPCL) to plan, appraise, approve, release funds, implement, manage, operate, monitor and evaluate the Kaleshwaram Project.

Managing Director, Kaleshwaram Irrigation Project Corporation Limited, Hyderabad has requested the Government to accord concurrence / approval for the terms and conditions of loan sanctioned by the Rural Electrification Corporation Limited for an amount of Rs. 18751.38 Cr (Including IDC) @ 10.90 % p.a towards implementation of additional 1 TMC of water per day consisting of Electro-Mechanical & Hydro-Mechanical components and all associated works under two schemes

Scheme 1: Rs.4657.95 Cr (Including IDC) for lifting of additional 1 TMC water per day from Medigadda Barrage on Godavari River to Reservoir at Sripada Yellampally Project (SYP) under Link-1 and

Scheme 2: Rs. 14,093.43 Cr ( Including IDC) for lifting of additional 1 TMC water per day from Mid Manair Reservoir to Sri Komaravelli Mallana Sagar Reservoir and to issue necessary orders with regard to required documents to be provided by the Government, in order to execute the loan agreement with the
REC ltd.

Government after careful examination of the matter, hereby accord approval for Financial Assistance of Rupee Term Loan from the Rural Electrification Corporation Limited to Kaleshwaram Irrigation Project Corporation Ltd., Hyderabad for an amount of Rs. 18751.38 Cr (Including IDC) @ 10.90 % p.a as per the terms and conditions annexed to this order towards implementation of additional 1 TMC of water per day consisting of Electro-Mechanical & Hydro-Mechanical components and all associated works under two schemes i.e.,
Scheme 1: Rs. 4657.95 Cr (Including IDC) for lifting of additional 1 TMC water per day from Medigadda Barrage on Godavari River to Reservoir at Sripada Yellampally Project (SYP) under Link-1 and Scheme

2: Rs. 14,093.43 Cr (Including IDC) for lifting of additional 1 TMC water per day from Mid Manair Reservoir to Sri Komaravelli Mallana Sagar Reservoir, subject to condition that the KIPCL shall pay guarantee commission at 2% consolidated for the entire guarantee period to Govt. and the amount shall be remitted to the following Head of Account for guarantee given by the Government, as the guarantee commission cannot be exempted as per RBI guidelines:

“0070 Other Administrative Services – 60. Other Services – MH 800. Other Receipts – SH 08 Commission” This order issues with the concurrence of the Finance (DCM) Department vide their U.O.No.4973/288/A1/DCM/2019, Dt.17-07-2019.

TERMS & CONDITIONS OF SANCTION OF RUPEE TERM LOAN

Security:

The loan shall be secured by unconditional and irrevocable guarantee from Govt. of Telangana for the repayment of loan, payment of interest, service charges thereon, additional interest, if any, and costs, charges, expenses, losses, applicable taxes, statutory duties and other money. The Government Guarantee shall be provided within a time of 6 months from the date of sanction.

Besides, hypothecation of assets created/to be created under the schemes shall also be provided in favour of REC [REC Ltd. (Formerly Rural Electrification Corporation Ltd.)] by KIPCL within 3 months of transfer of assets in favour of KIPCL by State Government.

The Borrower shall undertake that if, at any time during the subsistence of this Agreement, REC is of the opinion that the security provided by the Borrower has become inadequate to cover the balance of the loans outstanding, the Borrower shall provide and furnish to REC additional security as may be acceptable to REC to cover such deficiency.

Rate of Interest:

a. Interest rate of 10.90% p.a. on monthly rest with 3 year reset by providing rebate of 88 bps on the rates applicable for conventional generation schemes under A+ category borrower as per Lending rate circular issued time to time by REC. The interest rate is further subject to following conditions:-

i. If REC lending rate for KIPCL falls below 10.90%, the applicable interest rate shall be REC lending rate for KIPCL without any rebate;

ii. If REC lending rate for KIPCL is between 10.90% and 11.78%, the applicable interest rate shall be 10.90%.

iii. If REC lending rate for KIPCL goes above 11.78%, a rebate of 88 bps shall be applicable on REC lending rates for KIPCL.

b. The Interest shall be payable by the borrower on monthly basis. The 1st ‘Interest Due Date’ shall be the last day of the month in which the first disbursement is made and all subsequent ‘Interest Due Dates’ shall be the last day of every month till the full Loan amount along with all other dues are paid back to REC. There will not be any moratorium for payment of interest. All interest and their cost, charges, expenses shall accrue on daily basis and be calculated on the basis of actual number of days elapsed and an year of 365 days.

c. Notwithstanding anything stated hereinbefore, it will be open to REC to periodically reduce or enhance the rate of interest in respect of loan installments not disbursed up to the date of such revision. The revision in the rate of interest shall take effect from such date as may be notified by REC.

Loan period:

Repayment shall be 12 years (144 equal monthly instalments) commencing after scheduled completion date of 01.04.2021. A moratorium period of maximum 6 months’ is allowed. Interest shall be serviced on monthly basis with no moratorium period.

Mode of repayment:

The entire loan shall be repaid by the Borrower in 144 equal monthly installments and the 1st ‘Loan Repayment Due Date’ shall be last day of the month after moratorium period and all subsequent ‘Loan Repayment Due Dates’ shall be last day of each following month till the entire loan amount along with interest & all other dues are repaid to REC in full.

The sanction shall be valid for a period of six months from the date of sanction letter. However, REC can extend the validity period on the request of the borrower after being satisfied of the reasons of delay furnished by the Borrower.

Pre-commitment Conditions:

a) KIPCL shall undertake to seek approval/clearances from respective authorities for execution and operation of scheme(s).

b) KIPCL shall submit an undertaking that it shall acquire/obtain and maintain valid possession of land required for the scheme covered under the project throughout the tenor of REC loan.

c) KIPCL shall submit an undertaking that it shall obtain all statutory and non-statutory clearances/ approvals as required during implementation and operational phases of the proposed scheme(s) and will comply with the conditions specified therein.

d) KIPCL shall undertake that there is no duplication/overlapping of works with any other scheme(s) for which funding has been sought from REC/other banks and Fls

e) KIPCL shall undertake to arrange debt from Banks and Fls or budgetary support from Govt. of Telangana for the balance funds required for completion of the project/scheme.

f) The Borrowers shall give an undertaking that any change in its pattern of ownership including shareholding of government shall be subject to prior written approval of REC. Under such cases REC reserves the right to take necessary measures for safeguarding the interest of REC and to stipulate additional conditions including but not restricted to rate of interest, additional security, collateral etc.

g) KIPCL shall undertake that the total loan amount from REC/Banks/FIs availed by KIPCL shall not exceed the limit (presently Rs. 95,000 Crores) or as revised by Govt of Telangana at all times.

h) KIPCL shall submit the latest Expenditure certificate duly certified by Statutory auditor/Chartered Accountant.

i) KIPCL shall Indemnify REC in case of any tax, expense etc. implications with respect to loan availed from REC during the currency of the loan. All the charges shall be borne by KIPCL.

j) KIPCL shall undertake that the funds granted by the banks/FIs would be utilized for the purpose for which the loans were granted and the same would not be utilized for speculative purposes and/or for the payment of the interest and Term Loan Instalments and other borrowings.

k) KIPCL shall accept the unqualified right of REC/RBI/CIBIL/appropriate Statutory body to disclose/publish, in case of default, the details of the default, name of the company and its directors in such manner and through such media, as they may, in their absolute discretion, deemed fit.

l) KIPCL shall give an undertaking to the effect that the loan obtained from REC will be utilized exclusively for the purpose for which it is released and will also have to take necessary steps to ensure such utilization.

m) The Borrower shall undertake that if, at any time during the subsistence of this Agreement, REC is of the opinion that the security provided by the Borrower has become inadequate to cover the balance of the loans then outstanding, the Borrower shall provide and furnish to REC additional security as may be acceptable to REC to cover such deficiency.

n) The borrower shall undertake that it shall not take any additional debt exposure beyond the agreed funding pattern for the project and/or to take new project and/or expansion of existing project without the prior approval of REC.

o) Before entering into loan agreement with REC, Govt. of Telangana to provide a confirmation that the State Govt. Guarantee to be extended as security for the REC loan are within the available Fiscal Responsibility and Budget Management (FRBM) limits for Telangana State.

p) Borrower shall re-confirm the rating of the State from ICRA/from another rating agency after the current sanction of loan and submit the same to REC within 3 months of sanction.

Pre-disbursement Conditions:

a) Before disbursement, KIPCL shall arrange to submit a confirmation from Govt of Telangana that adequate provision will be kept in Annual Budget towards payments of principal, interest and other obligations of KIPCL towards REC’s loan during the currency of loan.

b) KIPCL shall clear the over dues, if any, to REC before start of disbursement.

c) The borrower shall, before the disbursement of loan, shall furnish a quarterly drawl schedule in the prescribed form.

d) Before first disbursement, KIPCL shall open separate/dedicated account for each scheme (for which loans are sanctioned by REC). KIPCL shall submit quarterly statement of the same, within 15 days of quarter ending.

e) Before first disbursement, KIPCL shall submit the No-default Certificate from MD/CS/CFO confirming that there is no default or over dues (payment of interest or principal) to any Bank/Financial Institution including REC at the time of disbursement. In case of over dues, the same shall be cleared before any disbursement by REC.

f) Disbursements shall be made based upon the utilization submitted by KIPCL supported with bills/invoices details etc.

Other Conditions:

a) KIPCL shall execute such Agreements and documents as are prescribed for the purpose by REC.

b) KIPCL shall furnish a resolution passed by its Board/shareholders, as may be required, to borrow from REC a loan of Rs. 18751.38 Cr. as per the terms and conditions prescribed by REC.
c) The amount of loan shall be released in tranches on execution of documents and complying with all terms and conditions specified for the loan.

d) A Memorandum of Agreement (MOA) i.e. Loan Agreement and other documents in the prescribed format shall be executed between the Borrower and REC before release of loan amount by REC.

e) The amount due (both interest payment as well as principal repayment) shall be paid by way of Demand Draft/ remittance in REC account at New Delhi under advice to this office. Remittance of each installment of interest and principal repayment shall be so paid to enable its credit in REC Account on or before due date. Bank charges/collection charges and other expenses shall be fully borne by KIPCL. If due date is a bank holiday at the recipient branch, the borrower has to remit the amount on the following working day. Any payment(s) received before the due date shall be deemed to have been received on the due date only.

f) The loans shall also be subject to further terms & conditions as incorporated in the format of Memorandum of Agreement/Other documents to be executed by KIPCL.

g) REC shall be fully empowered not to disburse any further loan, if it is found to its satisfaction that the loan or the loans already disbursed have not been properly utilized or obligation and commitment to REC in terms of provisions of the agreement are not fully met.

h) In the event of any installment of interest or of the principal, not being paid to REC by KIPCL on the due dates, KIPCL shall pay to REC a penal rate of compound interest (which is presently 2% p.a.) at the applicable rates as per REC circulars, over and above and in addition to the rate of interest stated herein above.

i) KIPCL shall also furnish to REC such reports on its working either in general or in specific relation to the sanction of this loan by REC in the manner prescribed by REC from time to time.

j) Borrower shall comply with any other condition that may be stipulated by REC to ensure and get satisfied that the loan amount granted is utilized only for the purpose for which it is intended. It will be open to REC to depute its officers and other staff for inspection of matters relating to this loan and its purpose and the inspection staff shall have access to such books, records and stores of the KIPCL as may be deemed necessary by the inspection staff.

k) REC also reserves its right to adjust/appropriate from any remittances made by the Borrower for the following dues under this loan as well as under any other Loan availed by the Borrower in the following order unless otherwise agreed:

i. All costs, charges, expenses, losses, applicable taxes, statutory duties and TDS and other moneys being due from the Borrower;
ii. Interest on costs, charges, expenses, losses, applicable taxes, statutory duties and TDS and other moneys. If any;
iii. Penal and/or Additional Interest including interest tax, if any;
iv. Any overdue Interest including interest tax, if any;
v. Any due Interest including interest tax, if any;
vi. Repayment of Principal falling due; and surplus remaining out of above, if any, shall be retained as an advance receipt of next falling due Interest and/or Principal installment.
l) Any prepayment of the Loan by the Borrower shall not be permitted except with the prior approval of REC and on such terms and conditions as may be decided by REC including payment of premium as per the policy of REC as may be applicable from time to time.

m) Notwithstanding anything stated above, REC reserves the right to cancel the commitments i.e. sanction loan amount or stand by facilities and credit lines, either fully or partially, unconditionally without prior notice at anytime or stipulate any condition as deemed fit.

n) The Borrower shall not raise borrowings from any other sources for meeting the cost of equipment/materials/works financed through this loan.

o) KIPCL shall confirm the possession of land and transfer of title in its favour, within 3 months’ time of first disbursement.

p) The Borrower shall take all necessary steps to ensure that the project is completed within stipulated completion date or such other date as may be agreed to by REC. The completion date of the project shall be 01.04.2021.

q) KIPCL shall furnish monthly progress reports by 15th of every month

r) Sale/Transfer/ Abandoning of the project by the borrower

The Borrower shall not sell/transfer or abandon the project at any stage in any manner without prior written consent of REC. In case at any stage or on a future date, the project is proposed to be transferred to any other organization or to be abandoned, the borrower shall seek prior consent of REC before any such transfer is affected and in such case, REC reserves the right to recall the loan with all outstanding dues including prepayment premium as applicable from time to time.

s) Right To Assign / Transfer The Loan To Other FIs, Banks & ARCs
During the currency of the loan, REC shall have the right to assign all or any of its obligations or transfer the loan to any other Financial Institution(s), Bank(s), Asset Reconstruction Company (ies) without the consent of the borrower.

t) The borrower shall during the currency of loans bear all such imposts, duties and taxes or any other charges as may be levied from time to time by the Government or other authority.

u) The Borrower shall be bound to follow and give effect to all instructions/ recommendations of REC. Further, REC reserves the right to impose any new conditions that deemed fit to take care of REC’s interest during the loan tenure.

v) Reimbursement of expenditure already incurred towards the works covered under the scheme(s) shall be permissible.

w) KIPCL shall obtain approval from CWC for the scheme, if required.

x) In case of privatization/ any amendment in the Act with respect to constitution of KIPCL, REC shall have the unqualified right to recall the loan.

y) KIPCL shall submit financials (quarterly) within 45 days from the end of the quarter and audited financial statements within two months from the end of the financial year.

z) Notwithstanding anything contained in this Loan sanction letter or the Loan agreement, the lender reserves the right to cancel the Commitments i.e. the sanctioned loan amount or standby facilities and credit lines, either fully or partially, unconditionally without any prior notice at any time.

aa) The closing date of loan shall be 6 months from the date of scheduled completion date (01.04.2021) or such other date as may be agreed by REC.

bb) If desired by the borrower, REC may make an advance payment as per the disbursement procedure of REC on completion of necessary loan documents. The utilization certificate from Statutory Auditor shall be submitted by the borrower normally within 6 months of the drawl against the advance.

cc) No dividend shall be declared by the borrower if there is any default in respect of REC’s loan.

dd) The borrower shall enter into agreement with Govt. of Telangana by 31.12.2019 whereby the assets proposed to be created under Kaleshwaram project are transferred in the name of the Kaleshwaram Irrigation Project Corporation Limited (KIPCL).

ee) REC shall have the right to appoint its officer as nominee director in the board of KIPCL till the time REC’s loan is repaid. KIPCL shall amend its articles of association accordingly.
