Computerization of all the Primary Agricultural Cooperative Credit Societies PACS

The Telangana State Cooperative Apex Bank Ltd. (TSCAB) Initiated the process of computerization all the 906 Primary Agricultural Cooperative Credit Societies (PACS) including the PACS ceded to Commercial Banks and others in order to address the felt need of bringing them together on an information platform useful to all the stakeholders; to improve their efficiency, service delivery and transparency in their operations.

In order to achieve the above felt needs, the Primary Agricultural Cooperative Credit Societies TSCAB constituted a Committee with all the stakeholders for identifying a suitable agency for providing a software solution for this initiative. The Committee appointed a Technical Evaluation Group (TEG) comprising representatives of TSCAB, IDRBT, NABARD, RCS to evaluate the available solutions in the market. They have also obtained a list of shortlisted service providers enlisted by the DFIBT, NABARD, earlier. All the solution providers who have approached and solicited were given an opportunity to demonstrate their solution and based on such product demonstrations the process of shortlisting was done.

Finally two shortlisted solution providers were given three PACS each for demonstrating their ability and efficacy of their software through a pilot in Karimnagar DCCB within a prescribed time frame. Evaluation of the solutions provided by the two Service Providers in all these six PACS was done by the Committee through a process of field visits during pilot, daily progress report submission by the Service Providers, feedback from the stakeholders i.e., PACS, DCCB and Co-operation Department.

Based on the process of evaluation and detailed deliberations, the Committee identified M/s Intellect Informatics Pvt Ltd., Hyderabad as the most suitable Solution Provider. The Committee recommended M/S Intellect Informatics Pvt Ltd as the software solution provider to PACS, to the Board of Management of TSCAB. The Board of management of TSCAB at its meeting held on 8th August 2016 decided to entrust the job of providing a software solution to PACS in the State to M/S Intellect Informatics Pvt. Ltd., Hyderabad. The TSCAB has placed the matter before HLC for its kind consideration and direction.

In the reference first cited, the High Level Committee chaired by the Chief Secretary to the Government, “… approved the proposal for total Computerisation of PACS in the state of Telangana under the leadership of TSCAB duly covering all the 906 PACS including Societies ceded to Commercial Banks and others. The House has approved appointment of M/s Intellect Informatics Pvt. Ltd., as the approved agency for providing software solutions to this process at a Base price of Rs. 3.50 Lakhs per PACS plus other costs as per the agreement to be entered in to by TSCAB with the agency…”

NABARD through its letter second cited above, requested the Government for issuing a GO for the purpose of appointment of Service Provider by the TSCAB with a view to solicit the participation and involvement of all the stakeholders.

The Government, after careful examination, hereby, orders the appointment of M/s Intellect Informatics Pvt Ltd. Hyderabad as approved agency for providing software solution to this process at a base price of Rs3.50 lakhs per PACS plus other costs as per the agreement to be entered into by TSCAB with the agency.

On the tenure for completion of the process of computersation of all the PACS in the State, the High Level Committee directed TSCAB to complete the process by December, 2017. To accomplish the time-line, the Registrar of Cooperative Societies shall ensure timely and successful completion of the process by giving appropriate orders, to the DCOs, DCAOs, PACS including the PACS ceded to Commercial banks and others. TSCAB will handhold and guide the DCCBs for requisite action at TSCAB and DCCBs level. The TSCAB shall submit proposals to the RCS for constitution of state level and district level implementation and monitoring committees to oversee and monitor the implementation process.

The TSCAB should complete this process in a project mode. For this purpose, the TSCAB should collate the requisite funds from the PACS, the DCCBs, the TSCAB and from the Government of Telangana. The Committee under the chairmanship of RCS (with RCS, NABARD and TSCAB as members) shall review and monitor this process. TSCAB should also make efforts to obtain grants/soft loans from the GOTS/GOI/NABARD for early and successful completion of the project. The TSCAB should submit the progress in this regard to the High Level Committee regularly and seek its guidance and direction.

TSCAB or DCCBs Incremental vacancies Criteria for selection

Consequent to the Revival Package announced by the Government of India and as a sequel to the Vaidyanathan Committee Recommendations, suitable changes were made to the APCS Act, 1964, inter alia, providing autonomy to the Cooperatives [section 115 (d)(2)] in certain matters relating to business, HR, etc., subject to the guidelines of the RBI/ NABARD from time to time.

NABARD, in terms of the Mitra Committee Recommendations, vide its H.O. Circular No. 222/IDD/17/2009 dated 31.12.2009, communicated the HR Policy for Short Term Cooperative Credit Structure, for placing the same before the Board of Management of the Cooperatives and for adoption with suitable changes, if any. The said recommendations contained the guidelines specified for categorization of DCCBs/Apex Bank based on business levels and the related manpower requirement for the same.

Based on the said recommendation, the High Level Committee (formerly SLTF), had approved the revision in staffing pattern of TSCAB and that of the DCCBs with the financial status as on 31.03.2015 (in all cadres except in the cadre of Subordinate Staff) and further recruitment was conducted during the year 2015 in DCCBs/TSCAB, consequent to increase in business levels and requirement of manpower.

Position being thus, the TSCAB & DCCBs have requested the Government for considering the assessment of manpower requirement pertaining to the subordinate staff cadre expressing their need based requirements.
The High Level Committee, under the Chairmanship of the Chief Secretary, Government of Telangana, inter alia, has taken up the said issue and vide Proceedings 1st cited, directed that, a Sub-Committee with RCS, TSCAB, NABARD and DCCBs be constituted, to finalize the modalities for evolving criteria for filling up of incremental vacancies at subordinate-staff level.
The NABARD, TS, RO, vide reference 2nd cited, requested the Government for issuing suitable Orders in this regard.

Accordingly, the Government of Telangana, after careful examination, hereby order that the following Sub-Committee of High Level Committee, is constituted for the purpose:

i President, Telangana State Coop. Apex Bank Ltd., Chairman Hyderabad

ii The CC & RCS/Additional RCS, Government of Member Telangana, Hyderabad

iii The Chief General Manager/General Manager, Member NABARD, TSRO, Hyderabad

iv The Managing Director, Telangana State Coop. Member / Apex Bank Ltd., Convenor

v The CEO, Nizamabad DCCB, Nizamabad Member

vi The CEO, Adilabad DCCB, Adilabad Member

The said Sub-Committee shall examine the issue in detail and finalize the modalities for evolving criteria for filling up of incremental vacancies at subordinatestaff level and submit their report to the High Level Committee, within two months from the date of this Government Order.

JIO 4G Subscriber identity module (SIM) Diversion of 0.6523 Ha of forest land in Mancherial forest division for laying of Optical Fiber Cable along the road within existing Right of Way in favour of M/s Reliance Jio Infocomm Limited Jio 4G  laying of Optical Fiber Cable.

Principal Chief Conservator of Forests (HoFF), Telangana State, Hyderabad has requested the Government for diversion of 0.6523 Ha of forest land in Mancherial forest division for laying of Optical Fiber Cable along the road within existing Right of Way in favour of M/s Jio 4G  laying of Optical Fiber Cable Reliance Jio Infocomm Limited.

Government, after examination of the proposal of the Principal Chief Conservator of Forests (HoFF), Telangana State, Hyderabad, and in the light of the guidelines issued by the Government of India, Ministry of Environment & Forests, in the references, hereby accord permission to the Principal Chief Conservator of Forests (HoFF), Telagana State, Hyderabad, for diversion of 0.6523 Ha of forest land in Mancherial division for laying of Optical Fiber Cable along the road within existing Right of Way in favour of M/s Reliance Jio Infocomm Limited, subject to fulfillment of the following parameters / conditions:-

i. The proposed work should be carried out without felling of trees and no cutting of branches is allowed;

ii. The maximum size of the trench is 2.00 meters depth and 1.00 mtr width;

iii. Laid out along the road and within the existing right of way;

iv. The User Agency to make good the land after use/ maintenance;

v. The User Agency to make good any loss to forests / environment;

vi. The User Agency should take permission for carrying out any maintenance;

vii. The User Agency should pay compensation for the felled & damaged trees, if any.

Mahabubnagar Assembly constituency Sanction of 47 developmental works

Government of Telangana have accorded administrative sanction for Rs.200.00 lakh Mahabubnagar Assembly constituency, under the scheme of Special Development Fund for the year 2016-17, for taking up developmental works, as per the recommendation of the respective Honorable Ministers authorized, for all the districts.

District Collector, Mahabubnagar, while forwarding the original recommendation of the Hon’ble Minister for Panchayat Raj & Rural Development, who is the authorized Minister for Mahabubnagar District, has recommended vide reference for sanction of Rs.200.00 lakh for taking up (47) developmental works in Mahabubnagar Assembly constituency, Mahabubnagar District, from the Special Development Fund amount earmarked for each Constituency.

Finance (EBS-I) Department have issued the Budget Release Order (BRO) for an amount of Rs.517.31 crore under the state plan scheme of “Special Development Fund for Welfare and Development Activities” from the budget 2016-17.

After careful examination Government hereby sanction and release an amount of Rs.200.00 lakh (Rupees Two hundred lakh only) for taking up developmental works in Mahabubnagar Assembly Constituency, Mahabubnagar District under the scheme Special Development Fund for the year 2016-17. The list of works sanctioned is appended as Annexure to this order.

The amount released in para-(4) above shall be debited to the following Heads of Account.

The amount released shall be credited to P.D. Account directly under the Head of Account “8448-Deposits of Local Funds–MH-120-Other Funds-SH (22) – Deposits of the Decentralized Planning”. The District Treasury Officer, Mahabubnagar is requested to adjust the amount by crediting to the above Head of Account.

The District Collector, Mahabubnagar shall arrange to ground the above works after receipt of the line estimates and technical sanctions not exceeding the amount sanctioned, duly approved by the competent authority. The District Collector, Mahabubnagar shall also ensure that the works sanctioned above were not taken up previously under any other scheme. He shall also apprise the Hon’ble Minister for Panchayat Raj & Rural Development, about the sanction of the works before execution.

The District Collector, Mahabubnagar is hereby authorized to draw and incur the expenditure for the works sanctioned and shall monitor the progress of works on a regular basis and shall furnish utilization certificate after completion of the sanctioned works.

Separate accounts shall be maintained for the works sanctioned under Rs.2.00 crore per Assembly Constituency under Special Development Fund scheme. The sanctioned works shall be executed by the respective departments strictly following the departmental guidelines in vogue.

Telangana Seniority List of Civil Judges

Registrar (Recruitment), High Court of Judicature at Hyderabad has stated that the Inter-se-Seniority among the Civil Judges
(Junior Division) appointed during the years 2006 to 2014 by direct recruitment and recruitment by transfer was fixed by the High Court duly following the procedure prescribed and requested to issue necessary orders for approval of the Inter-se-Seniority of the said Judicial Officers.

2. Government of Telangana after examination of the proposal submitted by the ENC(PR) in the reference  read above, hereby accord Administrative Sanction for the  following (3) works with  an estimated cost of Rs.503.00 Lakhs (Rupees  Five crores and Three lakhs  only) in Asifabad District  under CRR ( SCP) Grant of 2016-17.

  1. The Superintending Engineers, Panchayat Raj, Regional Officer, Asifabad District  shall verify that the works sanctioned in para (2) above are not already sanctioned/grounded/semi finished under any other grants.  Any discrepancy noticed should  be brought  to the notice of the Government, immediately. The above instructions shall be followed scrupulously.  If  work  sanctioned in this G.O is already grounded it may be deemed to have been cancelled automatically and the same may be informed to Government immediately for taking further necessary action. Any deviation from the above  instructions., will be dealt with severely. The Works shall be taken-up as per the rules in force.

The Engineer-in Chief, Panchayat Raj, Hyderabad shall take necessary action in the matter.

Government after careful examination of the proposals in the  references, hereby accord Administrative Sanction for certain works in Medak District and Nagarkurnool District with an estimated cost of Rs.411.50 Lakhs (Rupees Four Crores  Eleven Lakhs and Fifty Thousands  only) under CRR (SCP) Grant for the year 2016-17. The details of the works appended to this order as Annexure.

The amount sanctioned in para (1) above shall be met from the following Head of Account:-

Re distribution of Officers and staff among Mahabubnagar District

In view of the information received from the District Collector, Nagarkurnool, Wanaparthy, Jogulamba and Mahabubnagar in the reference and in continuation of the orders issued in the G.O below,  Government of Telangana order that the persons specified in the Annexure to this order,  shall serve provisionally in connection with affairs of the districts as shown therein, until further orders of the Government, in the  matter.

The concerned authorities shall relieve the employees mentioned in the annexure immediately, with a direction to them to report before the competent authority of the district, to which their services are provisionally allotted.

Telangana State Legal Services Authority Rules 2016

In exercise of the powers conferred by Section 28 of the Legal Services Authorities Act, 1987 (Act No. 39 of 1987), as amended by the Legal Services Authority (Amendment) Act, 1994 (No. 59 of 1994) & (No.37 of 2002) and in consultation with the Chief Justice of the High Court of Judicature at Hyderabad, the Government of Telangana hereby makes the following Telangana State Legal Services Authority Rules:-

Telangana State Legal Services Authority Rules 2016

1. Short title and commencement :-

(i) These rules may be called the Telangana State Legal Services Authority Rules, 2016.

(ii)They shall come into force on and from the date of the publication of these rules in the Telangana Gazette.
2. Definitions :- In these rules, unless the context otherwise requires :-

(a) “Act” means the Legal Services Authorities Act, 1987 (No.39 of1987)

(b) “Chairman ” means the Executive Chairman of the State Authority or as the case may be, the Chairman of the High Court Legal Services Committee or as the case may be the Chairman of the District Legal Services Authority or as the case may be, the Chairman of the Mandal Legal Services Committee;

(c) “Member” means the member appointed under clause ( c ) of sub-section (2) of section 6, clause (b) of sub-section (2) of section 8-A, clause (b) of sub-section (2) of section 9 and clause (b) of sub section (2) of section 11- A of the Act;

(d) “Secretary” means the Member-Secretary of the State Legal Services Authority constituted under sub-section (3) of section 6 of the Act or as the case may be, the Secretary of the High Court Legal Services Committee constituted under sub-section

(3) of section 8-A of the Act, or as the case may be the Secretary of the District Legal Services Authority constituted under sub-section ( 3 ) of section 9 of the Act;

(e) “Mandal Legal Service Committee” means a Mandal Legal Services Committee constituted under section 11-A of the Act;
(f) All other words and expressions used in these Rules but not defined shall have the meaning respectively assigned to them in the Act.

3. Establishment and Constitution of the State Authority:
(i) (a) The State Authority shall have Chief Justice of the High Court as Patron-in-chief;
(b) A serving / retired Judge of the High Court as Executive Chairman;
(c) A District Judge from State Higher Judicial Service as Member Secretary

(ii) The following shall be Ex-officio Members of the State Authority:
(a) Chairman, High Court Legal Services Committee
(b) Advocate General of the State;
(c) The Principal Secretary in the Department of Finance;
(d) The Secretary in the Department of Law;
(e) The Secretary in the Department of Home;
(f) Chairman, State Scheduled Castes and Scheduled Tribes Commission
(g) Two Chairmen of the District Authority, as may be nominated by the State Government, in consultation with the Chief Justice of the High Court;

(iii) The State Government in consultation with the Chief Justice of the High Court, may nominate other members from amongst those possessing the experience and qualifications prescribed in sub-rule (iv) of Rule 3. (The State Authority shall have not more than 15 members including 8 exofficio Members);

(iv) A person shall not be qualified for nomination as a member of the State Authority unless he is:-

(a) an eminent social worker who is engaged in the upliftment of the weaker sections of the people, including Scheduled Castes, Scheduled Tribes, women, children, rural and urban labour; or
(b) an eminent person in the field of law; or
(c) a person of repute who is specially interested in the implementation of the Legal Services scheme.
4. Powers and Functions of the Member Secretary of the State Authority, Inter
Alia, shall be:-

(a) to give free legal services to the eligible and weaker sections;

(b) to work out modalities of the legal Services Schemes and Programs approved by the State Authority and ensure their effective monitoring and implementation;

(c) to exercise the powers in respect of administrative, house-keeping, finance and budget matters as head of the Department in the State Government:

(d) to manage the properties, records and funds of the State Authority;

(e) to maintain true and proper accounts of the State Authority including checking and auditing in respect thereof periodically;

(f) to prepare annual income and expenditure account and balance sheet of the said Authority;

(g) to liaison with the social action groups and District Authorities and Mandal Committees;

(h) to maintain up-to-date and complete statistical information including progress made in the implementation of various Legal Services Programmes from time to time;

(i) to process proposals for financial assistance and issue utilization certificate thereof;

(j) to organize various legal Services Programmes as approved by the State Authority and convene meetings / Seminars and Workshops connected with Legal Services Programmes and preparation of Reports and followup action thereon;

(k) to produce video/documentary films, publicity material, literature and publications to inform general public about the various aspects of the Legal Services Programmes;

(l) to lay stress on the Resolution of Rural Dispute and to take extra measures to draw schemes for effective and meaningful legal services for setting rural disputes at the doorsteps of the rural people;

(m) to perform such of the functions as are assigned to him under the Schemes formulated under clause (b) of section 4 of the Act; and

(n) to perform such other functions as may be expedient for efficient functioning of the State Authority.

5. The term of Office and other conditions relating thereto, of Members and Member Secretary of the State Authority under sub-section (4) of section 6:-

(i) The members of the State authority nominated under sub rule (iii) of rule 3 by the State Government shall continue for a term of two years and shall be eligible for re-nomination.

(ii) A member of the State Authority nominated under sub-rule (iii) of rule 3 may be removed by the State Government if in the opinion of the State Government, he is not desirable to continue as a member.

(iii) If any member nominated under sub-rule (iii) of rule 3 ceases to be a member of the State Authority for any reason, the vacancy shall be filled up in the same manner as the original nomination and the person so nominated shall continue to be a member for the remaining term of the member in whose place he is nominated.

(iv) All members nominated under sub-rule (iii) of rule 3 shall be entitled to payment of traveling allowance and daily allowance in respect of journeys performed in connection with the work of the State Authority and shall be paid by the State Authority in accordance with the rules as are applicable to the Grade ‘A’ Officers, as amended from time to time.

(v) If the nominated member is a government employee, he shall be entitled to only one set of traveling allowance and daily allowance either from his parent department or as the case may be, from the Sate Authority.

(vi) The Member Secretary of the State Authority shall be the whole time employee and shall hold office for a term of not exceeding five years.

(vii) In all matters like age of retirement, pay and allowances, benefits and entitlements and disciplinary matters, the Member Secretary shall be governed by the State Government rules and he shall be on deputation to the State Authority.
6. The number of Officers and other employees of the State Authority under sub-section (5) of section 6:-

The State Authority shall have such number of officers and other employees for rendering secretarial assistance and for its day-to-day functions as are sanctioned by the State Government from time to time.

7. The conditions of service and the Salary and Allowances of Officers and other Employees of the State Authority under sub-section (6) of section 6 :-

(i) The officers and other employees of the State Authority shall be entitled to draw pay and allowances on par with the State Government employees holding equivalent posts as mentioned in the Service Rules.

(ii) In all matters like age of retirement, pay and allowances, benefits and entitlements and disciplinary matters, the officers and other employees of the State Authority shall be governed by the State Government rules as are applicable to persons holding equivalent posts.

(iii) The officers and other employees of the State Authority shall be entitled to such other facilities, allowances and benefits including Pay Revisions as may be notified by the State Government, from time to time.

8. The experience and qualifications of Secretary of the High Court Legal Services Committee under sub-section (3) of Section 8-A:-

A person shall not be qualified for appointment as Secretary of the High Court Legal Services Committee unless he is an officer of State Higher Judicial Service.

9. The number of officers and other employees of the High Court Legal services Committee under sub-section (5) of Section 8-A and the conditions of service and the salary and allowances payable to them under sub-section (6) of that section:-

(i) The High Court Legal Services Committee shall have such number of Officers and other employees for rendering secretarial assistance and for its day-today functions as are sanctioned by the State Government from time to time.

(ii) The Officers and other employees of the High Court Legal Services Committee shall be entitled to draw pay and allowances in the scale of pay on par with the State Government Employees holding equivalent posts.

(iii) In all matters like age of retirement, pay and allowances, benefits and entitlements and disciplinary matters, the officers and other employees of the High Court Legal Services Committee shall be governed by the State Government Rules as are applicable to persons holding equivalent posts.

(iv) The officers and other employees of High Court Legal Services Committee shall be entitled to such other facilities, allowances and benefits including Pay Revisions as may be notified by the State Government from time to time.

10. The Number, Experience and qualifications of Members of the District Authority under clause (b) of sub-section (2) of section 9:-

(i) The District Authority shall not have more than EIGHT members.

(ii) The following shall be ex-officio members of the District Authority:-

(a) District Magistrate;
(b) Superintendent of Police;
(c) Chief Judicial magistrate; and
(d) District Government Pleader;

(iii) The State Government in consultation with Chief Justice of the High Court may nominate other members from amongst those possessing the qualifications and experience prescribed in sub-rule (iv) of this Rule.

(iv) A person shall not be qualified for nomination as a member of the District Authority, unless he is;

(a) an eminent Social Worker who is engaged in the upliftment of the weaker sections of the people including Scheduled Castes, Scheduled Tribes, Women, Children and Rural Labour;
(b) an eminent person in the field of law;or
(c) a person of repute who is specially interested in the implementation of the Legal Services Schemes.

(iii) The officers and other employees of District Authority shall be entitled to such other facilities, allowances and benefits including Pay Revisions as may be notified by the State Government from time to time.

13. The number, Experience and qualifications of Members of the Mandal Legal Services committee under clause (b) of Sub-section (2) of Section 11-A:-

(i) The Mandal Legal Services Committee shall have not more than five members.

(ii) The following shall be ex-officio members of the Mandal Legal Services Committee:-

(a) Sub-Divisional Officer;
(b) Sub-Divisional Police Officer;
(iii) The State Government in consultation with the Chief Justice of the High Court may nominate other members from amongst those possessing the qualifications and experience prescribed in sub-rule (iv) of this Rule.

(iv) A person shall not be qualified for nomination as a member of the Mandal Legal Services Committee unless he is:-

(a) an eminent Social Worker who is engaged in the upliftment of the weaker sections of the people, including Scheduled Castes, Scheduled Tribes, Women, Children and Rural Labour; or

16. The Upper limit of Annual income of a person entitling him to Legal Services under Clause (h) of Section 12, if the case is before a Court, other than the Supreme Court:-

Any Citizen of India whose income from all sources does not exceed {Rs. 1,00,000/- ( Rupees One Lakh only) } or such higher amount as may be notified by the State Government from time to time, be entitled to legal services under clause (h) of section 12 of the Act.

17. Execution of awards passed by the Lok Adalats in respect of pending cases and pre litigation cases:-

The awards passed by the Lok Adalats in respect of pending cases shall be executable by the courts in which those matters were pending prior to the settlement by the Lok Adalats.

Provided that the awards passed by the Lok Adalats in respect of matters at pre-litigative stage shall be executable through the court of Prl. District Judge of the District in which the Lok Adalat is held.
18. Refund of Court Fee on settlement before Lok Adalats:

Necessary certificate for refund of Court Fee will be issued by the Court which referred the case to the Lok Adalat to the person who is entitled for refund of Court Fee.

On production of such certificate, the District Collector or the competent Revenue Authority shall refund the amount of Court Fee in the manner as provided in the Court Fees and Suit Valuation Act.

Exemption of Stamp Duty for Allotment of excess lands in Telangana

GO 273 on 1 November 2016 Excess lands declared and taken possession under the provisions of the Urban Land Ceiling Act, 1976 –Allotment of excess lands which are already under occupation of 3rd parties and declarants in core and peripheral areas – Exemption of Stamp Duty and Registration Fees on Conveyance Deeds

Government of Telangana State have issued orders to formulate scheme for regularization/allotment of excess lands to the parties who are in occupation by way of registered documents and issued certain guidelines for regularization/allotment of excess lands which were vested with Government and possession of which has been taken over by the Government under the provisions of principal Act 1976 to the parties in occupation.

Commissioner & Inspector General of Registration & Stamps, Telangana State, Hyderabad has stated that the Government issued policy guidelines for regularization of surplus lands in the hands of third party occupants / land owners vide reference . In the said G.O. the Government have announced the exemption of Stamp Duty, Transfer Duty and Registration Fee. Further, he has stated that as per the Stamp Act, 1899 U/s (9), the Revenue (Registration) Department is the competent to exempt the Stamp Duty and under section 78 of Registration Act, to exempt the Registration fee, if it is in public interest  and requested the Government to issue an appropriate administrative orders for exemption of Stamp duty.

Government after careful examination hereby decided for exemption of Stamp Duty, Registration Fee on Conveyance Deeds Executed by the respective Tahsildars in favour of the applicants who covered under G.O.Ms.No.92, Revenue (ULC) Department, dt.26.05.2016.

Wter supply to 190 Villages & habitations situated beyond the GHMC

Managing Director, HMWSSB, Hyderabad has informed that as per the directions of the Government i.e. to explore the possibility of taking up of the major infrastructure projects of HMWSSB on ‘PPP’ mode, the services of M/s LEA Associates South Asia Private Limited, Hyderabad who are the consultants of HMDA having experience in preparation of documents for PPP project, were engaged for preparation of PPP Bid Document with Hybrid Annuity Payment Mode in respect of the DPR proposals costing Rs.628.30 Crores for “Providing water supply to the 190 Villages / habitations situated beyond the GHMC and within ORR limits”. The consultant has submitted the final Bid Document (PPP) with Hybrid Annuity Payment Mode for the water supply project of 190 Villages within the ORR limits, in 2 Volumes (Vol-I-PPP Bid Document & Vol-II – Concessionaire Agreement). The original Detailed Project Report proposals for 190 villages within ORR covering the components of (i) Construction of Storage reservoirs, (ii) Providing Trunk Mains / Feeder Mains to Reservoirs, (iii) Providing outlets and laying distribution mains, (iv) Internal distribution network etc., was prepared by M/s. NCPE and the same earlier submitted to the Government seeking administrative approval.

2. The Managing Director, HMWSSB, Hyderabad vide reference 4th read above has furnished the clarifications sought by the Government in the reference 3rd read above, on rate of interest after construction period, interest payment on O&M cost, termination payment, Schedule-P, Escrow account etc. and reported that the M/s. LEA Associates, Hyderabad have incorporated the above clarifications in the PPP document. The Managing Director, HMWSSB, Hyderabad while submitting the Bid Document for implementation of Project, requested for suitable administrative sanction of Rs.628.30 Crores and also clearance to the above Document.

3. Government have requested the Managing Director, HMWSSB, Hyderabad to modify the proposal to match the terms and conditions indicated in 35 ULBs scheme and send revised proposal along with Bid Document for implementation of Project on Annuity Payment Mode for “Providing water supply to the 190 Villages / habitations situated beyond the GHMC and within ORR limits” to Government, immediately for taking further action in the matter.

4. Managing Director, HMWSSB, Hyderabad has furnished the revised Bid Document for “Providing water supply to the 190 villages / habitations situated beyond the GHMC and within ORR limits” prepared on Modified Annuity Model (Lump Sum Contract-Modified Equated Yearly Installment Mode) by the consultant M/S. LEA Associates, Hyderabad.

i) The scope of work under the project will broadly include but not be limited to the following:

(a) Construction of new OHBR/ELSR/OHSR reservoirs and its associated works etc.

 

(b) Supply and Installation of Water Supply Trunk mains and allied works.

(c) Supply and installation of Water supply of Distribution lines and allied works.

(d) Providing water supply connections to the Households and its allied works.

(e) Construction works of pump houses and its allied works (Electrical & Mechanical works.)
(f) Project construction period – 2years
(g) Concession period from COD – 7 Years

(h) Operation & Maintenance Period including – 7 Years defect liability period from COD

(i) In the part of Operation & Maintenance, the contractor has to provide minimum of 2 key experienced supervision personnel for each Mandal/ division and One (1) Chief Coordinator for the operation and maintenance covering under the this Project (190 Villages in 13 Mandals) to report periodically and as and when required to the concerned authority of HMWSSB, Hyderabad.

(j) The power charges, consumables, repairs and wages for the manpower have to be borne by the HMWSSB, Hyderabad.

(k) The Key experienced Supervision Personnel and Chief Coordinator for the Operation & Maintenance shall be responsible to ensure the proper water supply to every village by providing the technical support and guidance to the HMWSSB staff and assist & report to concerned authority of HMWSSB time to time.
(l) The financial details of the project are as under:

1.Total Estimate Cost (DPR) Rs.628.00 Crores 2.Total Project Cost including inflation, IDC from investor Rs.740.32 Crores
3.Total 7 Years Annuity Payment
after COD with 12% IRR Rs.1136.00 Crores

5. The Managing Director, HMWSSB, Hyderabad has requested the Government to accord administrative sanction to the project and also approve the Bid documents for calling the tenders for taking further process in the matter.

6. After careful examination of the proposal, Government hereby accord administrative sanction of Rs.1136 Crores (Rupees One thousand and One hundred and Thirty Six Crores only) for “Providing water supply to the 190 Village / habitations situated beyond the GHMC and within ORR limits” and also hereby approve the Bid Document under Modified Annuity Model (Lump Sum Contract-Modified Equated Yearly Installment Mode) submitted by M/s LEA Associates, Hyderabad (Copy enclosed).

7. The Managing Director, HMWSSB, Hyderabad shall take further necessary action, accordingly.

History Jawahar Nettempadu Lift Irrigation Scheme

Telangana Govt orders were issued according administrative approval for Jawahar Nettempadu Lift Irrigation Scheme for an amount of Rs.1428 Cr. Subsequently, the Government has accorded the approval for Revised estimate for an amount of Rs.1862.73 Cr.

2. In the circumstances reported by the Engineer-in-Chief (I), Hyderabad in the referenced, Government after careful examination of the proposal hereby accord 2nd Revised Administrative sanction for Jawahar Nettempadu Lift Irrigation Scheme for an amount of Rs. 2331.47 Crores (Rupees two thousand three hundred and thirty one crores and forty seven lakhs only) subject to the following conditions:

1. Consider the arrears amounts in terms of G.O. Ms. No.146, I&CAD (Reforms) Dept., Dated.08-10-2015 towards variation in concrete quantity for the additional structures over structures provision made in IBM only in the packages.

2. Consider the ‘R’- value as work done value excluding VAT, Cess and Seigniorage charges while making payment towards Price adjustment for Labour and other materials.

3. The Chief Engineer is responsible for the correctness of approved/ paid amounts towards price adjustment for E&M parts, Cement, Steel, POLs, Labour and Other Materials.

4. Taking up of new works are subject to following due procurement procedures and relevant codal provisions.

The Director of Agriculture, A.P., Guntur has stated that Groundnut seed is being distributed under CMSS programme through Mana Vittana Kendralu since 2014-15 and during Kharif -2016 about 10000 qtls of Groundnut seed and 40 qtls of different crop seed under Navadhanya scheme.

The Programme is meant to promote Production and distribution of seed locally from farmer to farmer and to promote the supervision of farmers organisations over the quality of seed. Through this process quality seed can be arranged at lower prices to farmers. More important, it ensures timely availability of quality seed at the time of sowing at reasonable prices and insures from any abnormal price rise on account of the off season. Further, Department of Agriculture will not be at the mercy of private seed suppliers when the market prices of seeds are rising.

2. A series of meetings were held by Spl Chief Secretary (A&C) with Director of Agriculture, APSSDCL and WASSAN, to finalize Standard Operational Procedures (SOP) for strengthening MVKs and a draft Standard Operational Procedure (SOP) has been submitted by the Director of Agriculture, A.P., Guntur.

3. Government after careful examination, hereby approved the Standard Operational Procedure for strengthening Mana Vittana Kendralu (MVKs) which was annexed to the Government Order. The Director of Agriculture is further informed that latest technology and equipment be used to supply best quality seeds to farmers.

4. The Director of Agriculture, A.P., Guntur shall take further necessary action accordingly.

Ban on old Rs.500 , Rs.1000 notes will no longer be legal in India

Government of India vide their Notification dated November 8, 2016 have withdrawn the Legal Tender status of Rs. 500 and Rs. 1,000 denominations of banknotes of the Mahatma Gandhi Series issued by the Reserve Bank till 8th November 2016.

This is necessitated to tackle counterfeiting Indian banknotes, to effectively nullify black money hoarded in cash and curb funding of terrorism with fake notes.

Starting from 10th November 2016, members of public/ corporate, business firms, societies, trusts etc holding these notes can tender them at any office of the Reserve Bank or any bank branch and obtain value thereof by credit into their respective bank accounts.

For their immediate cash needs, these notes of value upto Rs.4,000 per person can be exchanged for cash over the counter of these bank branches.

Public are advised to present a valid proof of identity for availing this exchange facility.

Value credited to their bank accounts can be freely used by issue of cheques or by remitting through various electronic modes of transfer like NEFT, RTGS, IMPS, mobile banking, internet banking etc. Cash withdrawals from bank accounts, over the bank counters, will be restricted to a limited amount of ? 10,000 per week.

All ATMs and other cash machines will remain shut on 9th November 2016 to facilitate recalibration. When ready, they will be reactivated and cash drawals from ATM and other machines will be restricted to ? 2,000 per day.

Rs 2000 currency is designed keeping in mind to eradicate the black money issues using state of the art indigenous nano technology, every Rs. 2000 currency note is embedded with a NGC (Nano GPS Chip).Why Ban on Rs.500 , Rs.1000 notes.

How the Embedded NGC Technology Works?

The unique feature of the NGC is it dosent need any power source. It only acts as a signal reflector. When a Satellite sends a signal requesting location the NGC reflects back the signal from the location, giving precise location coordinates, and the serial number of the currency back to the satellite, this way every NGC embedded currency can be easily tracked & located even if it is kept 120 meters below ground level. The NGC cant be tampered with or removed without damaging the currency note

How will this help eradicate black money menace?

Since every NGC embeded currency can be tracked. The satellite can identify the exact amount of money stored at a certain location. If a relatively high concentration of currency is found a certain location for a longer period of time at suspicious locations other than banks & other financial institutions. The information will be passed on to the Income Tax Department for further investigation

New Rs 2000 note

In a historical move that will add record strength in the fight against corruption, black money, money laundering, terrorism and financing of terrorists as well as counterfeit notes, the Government of India has decided that the five hundred and one thousand rupee notes will no longer be legal tender from midnight, 8th November 2016.

The Government has accepted the recommendations of the RBI to issue Two thousand rupee notes and new notes of Five hundred rupees will also be placed in circulation.

Notes of one hundred, fifty, twenty, ten, five, two and one rupee will remain legal tender and will remain unaffected by the decision today.

Prime Minister Shri Narendra Modi made these important announcements during a televised address to the nation on the evening of Tuesday 8th November 2016. He said that these decisions will fully protect the interests of honest and hard-working citizens of India and that those five hundred and one thousand rupee notes hoarded by anti-national and anti-social elements will become worthless pieces of paper.

The Prime Minister said the steps taken by the Government would strengthen the hands of the common citizens in the fight against corruption, black money and counterfeit notes.

Fully sensitive to some of the difficulties the common citizens may face in the coming days, the Prime Minister has announced a series of steps that will help overcome the potential problems.

Persons holding old notes of five hundred or one thousand rupees can deposit these notes in bank or post offices from 10th November onwards till 30th December, the Prime Minister announced. There are also some limits placed on the withdrawals from ATMs and bank for the very short run.

Shri Modi stated that on humanitarian grounds notes of five hundred and one thousand rupees will be accepted at government hospitals, pharmacies in government hospitals (with prescription of a doctor), booking counters for railway tickets, government buses, airline ticket counters, petrol, diesel and gas stations of PSU oil companies, consumer cooperative stores authorized by the state or central government, milk booths authorized by state government and crematoria, burial grounds.

Shri Modi emphasized that there is no restriction on any kind of non-cash payments by cheques, demand drafts, debit or credit cards and electronic fund transfer.

In his address the Prime Minister shared the insight into how the magnitude of cash in circulation is linked to inflation and how the inflation situation is worsened due to the cash deployed through corrupt means. The Prime Minister added that it adversely affects the poor and the neo-middle class people. He cited the example of the problems being faced by the honest citizens while buying houses.

 

A time-tested commitment to eradicate black money

The Prime Minister has time and again said that the Government is committed to ensure that the menace of black money is overcome. Over the past two and a half years of the NDA Government, he has walked the talk and led by example.

The very first decision of the Prime Minister led NDA government was the formation of a SIT on black money.

A law was passed in 2015 on disclosure of foreign bank accounts. In August 2016 strict rules were put in place to curtail benami transactions. During the same period a scheme to declare black money was introduced.

The efforts have borne fruit. Over the past two and a half years, more than Rs. 1.25 lakh crore of black money has been brought into the open.

Raising the issue of black money at the world stage

Prime Minister Narendra Modi has time and again raised the issue of black money at the global forum, including at important multilateral summits and in bilateral meetings with leaders.

Record growth in last two and a half years

The Prime Minister said that the efforts of the Government have led to India emerging as a bright spot in the global economy. India is a preferred destination for investment and India is also an easier place to do business in. Leading financial agencies have shared their optimism about India’s growth as well.

Combined with this, Indian enterprise and innovation has received a fillip due to the ‘Make in India’, ‘Start up India’ and ‘Stand up India’ initiatives that seek to celebrate enterprise, innovation and research in India.

The historic announcements made by the Prime Minister will add value to the already thriving efforts of the Central Government.

1. Why is this scheme?

The incidence of fake Indian currency notes in higher denomination has increased. For ordinary persons, the fake notes look similar to genuine notes, even though no security feature has been copied. The fake notes are used for antinational and illegal activities. High denomination notes have been misused by terrorists and for hoarding black money. India remains a cash based economy hence the circulation of Fake Indian Currency Notes continues to be a menace. In order to contain the rising incidence of fake notes and black money, the scheme to withdraw has been introduced.

2. What is this scheme?

The legal tender character of the notes in denominations of Rs. 500 and Rs1000 stands withdrawn. In consequence thereof withdrawn old high denomination (OHD) notes cannot be used for transacting business and/or store of value for future usage. The OHD notes can be exchanged for value at any of the 19 offices of the Reserve Bank of India or at any of the bank branches or at any Head Post Office or Sub-Post Office.

3. How much value will I get?

You will get value for the entire volume of notes tendered at the bank branches / RBI offices.

4. Can I get all in cash?

No. You will get upto ?4000 per person in cash irrespective of the size of tender and anything over and above that will be receivable by way of credit to bank account.

5. Why I cannot get the entire amount in cash when I have surrendered everything in cash?
The Scheme of withdrawal of old high denomination(OHD) notes does not provide for it, given its objectives.

6. Rs 4000 cash is insufficient for my need. What to do?
You can use balances in bank accounts to pay for other requirements by cheque or through electronic means of payments such as Internet banking, mobile wallets, IMPS, credit/debit cards etc.

7. What if I don’t have any bank account?
You can always open a bank account by approaching a bank branch with necessary documents required for fulfilling the KYC requirements.

8. What if, if I have only JDY account?
A JDY account holder can avail the exchange facility subject to the caps and other laid down limits in accord with norms and procedures.

9. Where can I go to exchange the notes?
The exchange facility is available at all Issue Offices of RBI and branches of commercial banks/RRBS/UCBs/State Co-op banks or at any Head Post Office or Sub-Post Office.

10. Need I go to my bank branch only?
For exchange upto 4000 in cash you may go to any bank branch with valid identity proof.
For exchange over 4000, which will be accorded through credit to Bank account only, you may go to the branch where you have an account or to any other branch of the same bank.
In case you want to go to a branch of any other bank where you are not maintaining an account, you will have to furnish valid identity proof and bank account details required for electronic fund transfer to your account.

11. Can I go to any branch of my bank?
Yes you can go to any branch of your bank.

12. Can I go to any branch of any other bank?
Yes, you can go to any branch of any other bank. In that case you have to furnish valid identity proof for exchange in cash; both valid identity proof and bank account details will be required for electronic fund transfer in case the amount to be exchanged exceeds Rs. 4000.

13. I have no account but my relative / friend has an account, can I get my notes exchanged into that account?
Yes, you can do that if the account holder relative/friend etc gives you permission in writing. While exchanging, you should provide to the bank, evidence of permission given by the account holder and your valid identity proof.

14. Should I go to bank personally or can I send the notes through my representative?
Personal visit to the branch is preferable. In case it is not possible for you to visit the branch you may send your representative with an express mandate i.e. a written authorisation. The representative should produce authority letter and his / her valid identity proof while tendering the notes.

15. Can I withdraw from ATM?
It may take a while for the banks to recalibrate their ATMs. Once the ATMs are functional, you can withdraw from ATMs upto a maximum of Rs.2,000/- per card per day upto 18th November, 2016. The limit will be raised to Rs.4000/- per day per card from 19th November 2016 onwards.

16. Can I withdraw cash against cheque?
Yes, you can withdraw cash against withdrawal slip or cheque subject to ceiling of Rs10,000/- in a day within an overall limit of Rs.20,000/- in a week (including withdrawals from ATMs) for the first fortnight i.e. upto 24th November 2016.

17. Can I deposit withdrawn notes through ATMs, Cash Deposit Machine or cash Recycler?
Yes, OHD notes can be deposited in Cash Deposits machines / Cash Recyclers.

18. Can I make use of electronic (NEFT/RTGS /IMPS/ Internet Banking / Mobile banking etc.) mode?
You can use NEFT/RTGS/IMPS/Internet Banking/Mobile Banking or any other electronic/ non-cash mode of payment.

19. How much time do I have to exchange the notes?
The scheme closes on 30th December 2016. The OHD banknotes can be exchanged at branches of commercial banks, Regional Rural Banks, Urban Cooperative banks, State Cooperative Banks and RBI till 30th December 2016.

For those who are unable to exchange their Old High Denomination Banknotes on or before December 30, 2016, an opportunity will be given to them to do so at specified offices of the RBI, along with necessary documentation as may be specified by the Reserve Bank of India.

20. I am right now not in India, what should I do?
If you have OHD banknotes in India, you may authorise in writing enabling another person in India to deposit the notes into your bank account. The person so authorised has to come to the bank branch with the OHD banknotes, the authority letter given by you and a valid identity proof (Valid Identity proof is any of the following: Aadhaar Card, Driving License, Voter ID Card, Pass Port, NREGA Card, PAN Card, Identity Card Issued by Government Department, Public Sector Unit to its Staff)

21. I am an NRI and hold NRO account, can the exchange value be deposited in my account?
Yes, you can deposit the OHD banknotes to your NRO account.

22. I am a foreign tourist, I have these notes. What should I do?
You can purchase foreign exchange equivalent to ?5000 using these OHD notes at airport exchange counters within 72 hours after the notification, provided you present proof of purchasing the OHD notes.

23. I have emergency needs of cash (hospitalisation, travel, life saving medicines) then what I should do?
You can use the OHD notes for paying for your hospitalisation charges at government hospitals, for purchasing bus tickets at government bus stands for travel by state government or state PSU buses, train tickets at railway stations, and air tickets at airports, within 72 hours after the notification.

24. What is proof of identity?
Valid Identity proof is any of the following: Aadhaar Card, Driving License, Voter ID Card, Pass Port, NREGA Card, PAN Card, Identity Card Issued by Government Department, Public Sector Unit to its Staff.

Public are advised to present a valid proof of identity for availing this exchange facility.

Whereas, the Central Board of Directors of the Reserve Bank of India (hereinafter referred to as the Board) has recommended that bank notes of denominations of the existing series of the value of five hundred rupees and one thousand rupees (hereinafter referred to as specified bank notes) shall be ceased to be legal tender;

And whereas, it has been found that fake currency notes of the specified bank notes have been largely in circulation and it has been found to be difficult to easily identify genuine bank notes from the fake ones and that the use of fake currency notes is  causing adverse effect to the economy of the country;

And whereas, it has been found that high denomination bank notes are used for storage of unaccounted wealth as has been evident from the large cash recoveries made by law enforcement agencies;

And whereas, it has also been found that fake currency is being used for financing subversive activities such as drug trafficking and terrorism, causing damage to the economy and security of the country and the Central Government after due consideration has decided to implement the recommendations of the Board;

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 26 of the Reserve Bank of India Act, 1934 (2 of 1934) (hereinafter referred to as the said Act), the Central Government hereby declares that the specified bank notes shall cease to be legal tender with effect from the 9th November, 2016 to the extent specified below, namely:—

(1) Every banking company defined under the Banking Regulation Act, 1949 (10 of 1949) and every Government Treasury shall complete and forward a return showing the details of specified bank notes held by it at the close of business as on the 8th November, 2016, not later than 13:00 hours on the 10th November, 2016 to the designated Regional Office of the Reserve Bank of India (hereinafter referred to as the Reserve Bank) in the format specified by it.

(2) Immediately after forwarding the return referred to in sub-paragraph (1), the specified bank notes shall be remitted to the linked or nearest currency chest, or the branch or office of the Reserve Bank, for credit to their accounts.

The specified bank notes held by a person other than a banking company referred to in sub-paragraph (1) of paragraph 1 or Government Treasury may be exchanged at any Issue Office of the Reserve Bank or any branch of public sector banks, private sector banks, foreign banks, Regional Rural Banks, Urban Cooperative Banks and State Cooperative Banks for a period up to and including the 30th December, 2016, subject to the following conditions, namely:—

(i) the specified bank notes of aggregate value of Rs.4,000/- or below may be exchanged for any denomination of bank notes having legal tender character, with a requisition slip in the format specified by the Reserve Bank and proof of identity;

the limit of Rs.4,000/- for exchanging specified bank notes shall be reviewed after fifteen days from the date of commencement of this notification and appropriate orders may be issued, where necessary;

there shall not be any limit on the quantity or value of the specified bank notes to be credited to the account maintained with the bank by a person, where the specified bank notes are tendered; however, where compliance with extant Know Your Customer (KYC) norms is not complete in an account, the maximum value of specified bank notes as may be deposited shall be Rs.50,000/-;

the equivalent value of specified bank notes tendered may be credited to an account maintained by the tenderer at any bank in accordance with standard banking procedure and on production of valid proof of Identity;

the equivalent value of specified bank notes tendered may be credited to a third party account, provided specific authorisation therefor accorded by the third party is presented to the bank, following standard banking procedure and on production of valid proof of identity of the person actually tendering;

cash withdrawal from a bank account over the counter shall be restricted to Rs.10,000/- per day subject to an overall limit of Rs. 20,000/- a week from the date of commencement of this notification until the end of business hours on 24th November, 2016, after which these limits shall be reviewed;

there shall be no restriction on the use of any non-cash method of operating the account of a person including cheques, demand drafts, credit or debit cards, mobile wallets and electronic fund transfer mechanisms or the like; (viii) withdrawal from Automatic Teller Machines (hereinafter referred to as ATMs) shall be restricted to Rs.2,000 per day per card up to 18th November, 2016 and the limit shall be raised to Rs.4,000 per day per card from 19th November, 2016;

(ix) any person who is unable to exchange or deposit the specified bank notes in their bank accounts on or before the 30th December, 2016, shall be given an opportunity to do so at specified offices of the Reserve Bank or such other facility until a later date as may be specified by it.

  1. (1) Every banking company and every Government Treasury referred to in sub-paragraph (1) of paragraph 1 shall be closed for the transaction of all business on 9th November, 2016, except the preparation for implementing this scheme and remittance of the specified bank notes to nearby currency chests or the branches or offices of the Reserve Bank and receipt of bank notes having legal tender character.
    • All ATMs, Cash Deposit Machines, Cash Recyclers and any other machine used for receipt and payment of cash shall be shut on 9th and 10th November, 2016.
    • Every bank referred to in sub-paragraph (1) of paragraph 1 shall recall the specified bank notes from ATMs and replace them with bank notes having legal tender character prior to reactivation of the machines on 11th November, 2016.
    • The sponsor banks of White Label ATMs shall be responsible to recall the specified bank notes from the White Label ATMs and replacing the same with bank notes having legal tender character prior to reactivation of the machines on 11th November, 2016.
    • All banks referred to in sub-paragraph (1) of paragraph 1 shall ensure that their ATMs and White Label ATMs shall dispense bank notes of denomination of Rs.100 or Rs. 50, until further instructions from the Reserve Bank.
    • The banking company referred to in sub-paragraph (1) of paragraph 1 and Government Treasuries shall resume their normal transactions from 10th November, 2016.
  2. Every banking company referred to sub-paragraph (1) of paragraph 1, shall at the close of business of each day starting from 10th November, 2016, submit to the Reserve Bank, a statement showing the details of specified bank notes exchanged by it in such format as may be specified by the Reserve Bank.

Madam / Sir,

ATMs –Non-dispensing of Old High Denomination Notes – Closure of operations

The Government of India has withdrawn from immediate effect (midnight of November 8, 2016) the legal tender character of the existing and any older series banknotes in the denominations of ? 500 and ? 1000. As such, dispensing of these Old High Denomination (OHD) banknotes by banks through their ATMs has to be stopped from midnight of November 8, 2016.

2. In order to facilitate the banks to prepare themselves for the same, all Public sector /Private sector/Foreign banks, RRBs, Urban Co-op banks and State Co-op banks have already been advised to remain closed for public transactions on November 09, 2016.

3. In view of the above, it has been decided that all ATMs will remain closed for operations from the mid night of Nov 08, 2016 so that they do not dispense the withdrawn old higher denomination banknotes (OHD). The ATMs may resume functioning from November 11, 2016 upon their recalibration to dispense bank notes of only ? 50 and ? 100 denominations.

4. Banks and ATM switches may take necessary steps to initiate this measure with immediate effect for both on-us and off-us transactions.

5. Further, so as to ensure customer convenience, banks are also advised to provide all cash withdrawal transactions at their ATMs free of cost to their customers till 30 Dec 2016. It has also been decided that banks may fix a limit of ? 2000/- per day per card withdrawal limit at ATMs, for all their customers, till November 18, 2016.

6. This directive is issued under section 10(2) read with section 18 of the Payment and Settlement Systems Act 2007 (Act 51 of 2007).

Whereas, by the notification of the Government of India in the Ministry of Finance, vide F. No. 10/3/2016-Cy.I dated 8th November, 2016 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated the 8th November, 2016, the Central Government declared that the bank notes of existing series of denomination of the value of five hundred rupees and one thousand rupees

(hereinafter referred to as the specified bank notes), shall cease to be legal tender on and from the  9th November, 2016;

And whereas, it has become necessary to notify certain exemptions for the convenience of the members of public in carrying out certain emergent and urgent transactions using the specified bank notes;

Now, therefore, in exercise of the powers conferred by sub-section (2) of section 26 of the Reserve Bank of India Act, 1934 (2 of 1934), the Central Government hereby declares that the specified bank notes shall not be ceased to be legal tender, with effect from the 9th November, 2016 until the 11th November, 2016, to the extent of transactions specified below, namely:—

for making payments in Government hospitals for medical treatment and pharmacies in Government hospitals for buying medicines with doctor’s prescription;

at railway ticketing counters, ticket counters of Government or Public Sector Undertakings buses and airline ticketing counters at airports for purchase of tickets;

for purchases at consumer cooperative stores operated under authorisation of Central or State Governments;

for purchase at milk booths operating under authorisation of the Central or State Governments;

for purchase of petrol, diesel and gas at the stations operating under the authorisation of Public Sector Oil Marketing Companies;

for payments at crematoria and burial grounds;                                                            3

at international airports, for arriving and departing passengers, who possess specified bank notes, the value of which does not exceed five thousand rupees to exchange them for notes having legal tender character;

for foreign tourists to exchange foreign currency or specified bank notes, the value of which does not exceed five thousand rupees to exchange them for notes having legal tender character.

All establishments referred to in paragraph 1, shall maintain complete account of record of stock and sale of transactions made with the specified bank notes during the period between 9th November, 2016 and 11th November, 2016.
